ive been doing lots of reading while im filing out the forms. i kinda slacked a bit with the whole emotion and arranging of our wedding. we are now getting married in 2 weeks and our I-94 expires in 3 weeks. if i've understood correctly we have until the I-94 expires to file for AOS. im kinda unclear on a few things but for now im gonna start with this question....

Do both of us need to send the G-325a?

I have to update mine since we will be married and i have changed jobs and residence since the 1st time we sent the g-325a (K1 visa)?

In the G-325a, under Husband or Wife im confused because the example form is confusing and i have read lots of mixed answers. My wife is the beneficiary and she will write HUSBAND? and then whose information is stated (family name, first name, birth date, ...etc)

Also my wife is going to keep her original name and not change her last name to mine, if we state WIFE, we write her original and madien name? (which are the same)

We will be filing AOS for K1 and K2 visas, do i do all the same forms for the K2?

Sorry to bombard with so many questions, i will keep reading along and try to not have to ask so many questions at once. Please help, thank you

Not true. You have until your I-94 expires to marry. You don't actually have to file for AOS before the I-94 expires, though it is probably a good idea to not drag your feet and do it as soon as you can.

No, only the immigrant sends one/fills one out.

nope

She writes "husband" and then your info.

I don't know anything about K2s. Someone else will have to chime in on that one.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

You do not need a G-325a for yourself or for a child K-2 IF the child is under 14 years old.

The form is your wife's she should answer it as she would answer...she has a husband...YOU. It is HER family they ask about. For most you can copy her G-325a from the I-129f petition and add her address here in the USA as her "current address". Complete the form in the name she wishes the green card to be in.

For the K-2, YES, the same forms except no G-325a if under age 14, you need an I-864 with supporting documents for both. If the child is under age 14 and files AOS with the mother, the fee is $600. If over age 14 or filed separately the fee is the same as the mother, $1010

thank you for your help rsn.

does anyone know about AOS for K-2 while filing the K-1/K-2 together?

Yes, I have done them both together and separately (K-2 and K-2 to follow), I think I answered your question above, but maybe not.

thanks Gary, do we need to also file I-864a? i already have questions regarding the I-864 because i have already started it aswell. i dont know if i have to put or mention the K2 on there as well. i am going to do as much as possible and then research and read to see if i can answer my questions but the K1/K2 is alittle confusing at least on the questions on the I-864. thanks again
