I have returned from the US back to the UK after a months stay. I have booked another trip out there to see my FIancee from 16/08/2006 to 13/11/2006. This works out as exactly 90 days. We haven't started the Fiance visa yet so that is not a problem. What is worrying me is that I am staying exactly 90 days. Will I be refused entry for that reason? I have the e-ticket with everything saying I'm leaving on the 90th day but I'm worried. On the US Embassy website it states "for less than 90 days".

Hope you guys can help me.

As long as you have sufficient ties to prove that you will be returning (return ticket, lease, letter from work, etc.) in the event that you *do* get questioned, you shouldn't have a problem. Since you have stayed here before, it is possible that you will be looked at with closer scrutiny, so be prepared. My own husband did it, so it certainly is possible; although he was questioned very closely on the last visit before we giot the visa. He had his tenancy agreement, a letter frmo his job, bank statements, the visa paperwork thus far, and a return ticket to back him up, so they let him through.

I think a lot depends on how many trips you have done..If this 90 day trip is your first, should be no problem. After my fourth 90 day trip in two years, I was told it would be my last for at least a year without that K-1 in my hot little hand!

April 14 - sent I-129F to Vermont

April 25 - NOA1

May, June, July lost to IMBRA and RFE's

Aug 22 - NOA2

Sept 25 - interview date OCTOBER 13th

Oct 26 - arrived at JFK - work authorized

Nov 21 - apply SSN, received Nov 29

Dec 16 - marriage license

2007

Jan 05 - wedding

Jan 30 - AOS begins

AOS

Feb 07 - NOA1 ,check cashed

Feb 28 - notice I-485 sent to CSC

Mar 10 - Biometrics

Apr 16 - surprise RFE arrives..they lost my medical. New medical returned, Apr 23

Jun 1st - RFE ..more medical BS ( go back for TB skin test)

Jun 28 - CARD PRODUCTION ORDERED!!!

July 06- Green card arrives.

LIFTING CONDITIONS 2009

June 12 - mailed package

June 15 - check cashed

June 19 - NOA extension letter ( card expires June 26th)

July 03 - Biometrics notice

July 14 - Biometrics appointment

OCT 29 - CARD PRODUCTION ORDERED!!!

I think a lot depends on how many trips you have done..If this 90 day trip is your first, should be no problem. After my fourth 90 day trip in two years, I was told it would be my last for at least a year without that K-1 in my hot little hand!

I have been once before, this year from 08/06/2006 to 07/07/2006. The thing is I won't have a job. Will that impede me? I also live with my Parents so I don't own anything. What can I use to say I am coming back?

Job centre appointemnt? Job interview appointment?

If you haven't got one MAKE one, (if you can get one so far in advance) and get it in writing - its not the best proof but its something.. I know what you mean about lack of 'proof' - its hard if you don't own a property, or work as a temp even - cos you have no employment 'record'.

Also be aware that if you have a few trips close together for long periods the POE ppl SOMETIMES view it as 'using VWP to live in US, or commute' - and deny entry on that basis.

Have you any plans for travel inside the US to see sights?

If not make some - or have guides etc for places you 'want to visit'. which would 'explain' the length of your visit.

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

hmm sorry, Im stumped on that one.

Ive always been asked what do you do, why do have so much time to spare, how can you afford to be away so long??? etc. Although that happened on the 3rd and 4th trip. My second trip I'd said that I didn't finish seeing everything I wanted to see the first time around. I was only asked if I had the finances to be able to stay that long. Told them yes, and had bank details which they did not ask to see.

Are you a student?

Hopefully someone with a situation like yours will be able to share their experience.

I recently stayed for 86 days in the States to visit my then girlfriend, now fiance. I was expecting it to be no problem at all at the border, just as I hadn't really thought about it. I was questionned for a surprisingly long time about what I did, what I was doing there and how I was going to support myself. I told the officer that I had savings, and that I was basically there to see if we could live together, and if yes, we would be filing for a visa etc. Eventually he let me in, and didn't ask to see proof of savings etc, but I would say it is worth taking any evidence you can. Particularly if you have recently visited for a reasonable length of time.

I'm not a student no. My Dad's self-employed and I sort of work for him off the record and Temp the rest of the time. I'm really worried now I've read all sorts of Horror stories about Officers turning people away for multiple visits. This is only my second visit though ever. I have no intention of staying after 90 days and have booked a return flight. As for supporting myself well I'm taking my ATM card but my Fiancee will be supporting me mostly.

Sh*t I'm really, really worried now. I don't want my Fiancee to be mere yards away and me deported back to England without seeing her.

I have been twice, both for 90 day periods...with no questions at all....either times...I was going to go back again for a couple of weeks while I wait on my interview but seeing I have to wait around till the 27th etc for my doc appointment now I'm wondering...I do know how you feel and this is major major stress and *bs*....I was worried the second time I went in even though my fiance was with me... :(

  • **Waiting for Notice of I129F approval to show up in the mail!**
  • NOA2 Showed up in mail Wed 24th May 2006
  • ** Nervous as all hell - Still no Instruction packet**
  • ** 27th June Email - Saying Application Approved??? **
  • July 7th Packet 3 Arrived (First one went missing? - this one was marked 'duplicate')
  • Pack 4 arrived 31st July
  • Appointment 18th Aug

i didnt have no problems... i left germany on the 30th of april and im staying in the states until the 28th of july. they asked more questions than usual at the american airport and my luggage was double checked. but other than that there werent any problems....

questions they asked me:

yeah but how many times have you been to the US in say the last 2 years? they didn't ask me anything either when I went in but I have only been twice....I think thats more what he is worried about frequent visits.... :(

Thank you for all the help. I'm a little better now. I know that its ultimately up the Officer in Detroit. But as my first visit was for only 30 days I think I'll be okay. I'll just tell the truth I'm seeing my Girlfriend (I'll not mention Fiance to him!!) I'm a temp so can take unpaid time off and have saved up for this trip.

Might want to have your ticket be for slightly less than 90 days (as mentioned). Any complication or dely (like weather) could put you into an unintentional overstay. It's happened before--leave yourself a little buffer while you look at the big picture. :)
