Hey everyone...

My fiance (K-1) and I are getting married on 8/2/09 and her I-94 expires on 8/5/09. We were under the impression that we could wait until after marriage to apply for a Social Security Number. But now I am reading that they won't accept applications when the I-94 is within 14 days of being expired!! Will she be able to apply for a SSN after we get married based on a valid marriage certificate? Or will they not accept the application based on the expired I-94?? I'm worried that we may have scewed up big time here!!! Someone please tell me different...

She will now have to wait until she has either an EAD or GC to get SSN

As what I have understood, SSN applications CANNOT be accepted before the 14 days of US arrival. Please correct me if I'm wrong.

I suggest that you call the nearest SSN office and inquire about it.

OK I will. LOL

SSA will not clear an application if at that time the individual's immigration status is with in 14 days of expiring. It's possible to apply as a K-1 the first day you arrive and if your are within 14 days of your status expiring at the time your status has been verified, the application is going to be denied.

Even though it's possible to clear the application up to the 75th day you have been here. I would suggest that if possible you give yourself at least 30 days to allow for the amount of time it might take to complete the status verification.

The other thing is that you wait 10 days after you arrive before applying to allow for your entry to be entered into the database SSA uses to verify your status, but this is not a requirement. The SSA office is supposed to hold the application until you have been here 10 days and try another initial status verification if you didn't verify with the one while you were in the office, before going on to the next step of the verification process, but you can't always count on them to do the right thing.

I don't think you have to wait 2 weeks. She told me the ones that had to wait are CR1 or ones that enter which is already a GC holder... then they system automatically generates one SSN for them.

As I said, waiting 10 days is not required. In your case not waiting didn't cause you any problem, but it doesn't work for everyone.

People age 18 or older that are issued immigrant visas and checked off on the DS-230 that they wanted to be assigned an SSN need to wait three weeks before applying. The reason they need to wait is if they don't they could possibly wind up being assigned 2 SSNs. If you are under age 18 or didn't check off on the DS-230 you don't need to wait the three weeks.
