Inbetween applying for AOS and getting GC/EAD

Timeline

Okay, I've looked in the forums, the guides, called SSA, USCIS, and no answer. So here it goes...

We have applied for AOS, EAD, and AP. Just today we have received the I-797C notices for all three.

The question is, what is my wife's status (she came here on a K-1) right now? Can she get a driver's license? Can she go to school here as a resident?

We called the Social Security Administration and they told us that she will have to wait for her EAD before changing her last name in their records?

I am sure other K-1 holders have been in the same boat. What do you do for the 60-90 days before you get your EAD?

Her current status is "Pending."

Driver's License? Maybe - depends on the state - most likely the answer is no however. Most states require either the EAD or PR/Green Card to issue the DL. Check your local state's requirements.

Can not (in most cases) be considered a resident for university purposes - varies widely by institution - some (for example) require residency of a year or more before a person is considered a resident (with or without the PR/Green Card). Again - varies widely by institution.

In the mean time - Karin got to know her surroundings - studied for the driver's license test - etc.
