Hello everybody

I am in process to get my green card thru marriage. But unfortunatelly someone in family has died and without a second thought I left the US for the funeral.

I didn't have time to get an advance of parole or anything like that.

My question is...can I start the process from my home country or I should have done this before I leave.

There is nO proof I left the US because my I-94 is with USCIS.

Is there any hope for my case??Please help. :blink:

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

What was your status in the US before you left? How did you enter the US initially?

I had my interview in february at the San Francisco office to change my status. I haven't heard anything since then. I entered the US as a fiancee.

If you were applying for adjustment of status and you left the US without AP or a greencard then you have abandoned your application for AOS and will need to file for a spousal visa from your home country.

Your spouse will need to send a I-130 to USCIS to get the process started. Sadly you will have to wait for the CR-1 visa before you can enter the US.

You can not apply for Advance Parole after you have left the US you must have the approved AP with you when you depart.
