i-864 intending immigrant incom

Hey, guys! A quick question:

I am still working on my rfe (been 2 weeks), getting all the docs together, etc. We've included my income (immigrant), so we can pass the poverty line guidelines, but received a rfe that stated I had to sign i-864a. I thought, since I was the intended immigrant, I didn't have to sign that form?

I-864A is for the household member to combine their income with that of the sponsor. This is your form with only your income information.

The USC spouse is the primary sponsor that completes the I-864.

so why the hell do they want me to sign the form? In our i-864, we checked the box where it said "the above person does not need to sign i-864a since he/she is the intending immigrant..."

edit: our joint sponsor have recently(february 09) became a partner at a restaurant chain. His payroll still lists him under w-2. The instructions say that he has to attach one of the schedules: C, d, e, etc. Since he just became a partner, he wouldn't have those available. What should we do? should we include him in "employed by" or "self-employed" category. He has an hourly rate + some partner's percentage, depending on the store performance

Reading the I-864 form, on line 24 you would not check the box for 24d if the only household member listed is the intending immigrant. You would check the box for line 24e which states that an I-864A is not needed.

An I-864A does need to be signed. From what you've said you should have checked the 24e box and NOT completed the 864A. Now you need to submit a new, properly completed I-864.

Regarding the joint sponsor, if they are not a household member then they must show enough income on their own to sponsor the immigrant. Regardless, just list them as an employee and submit the employee letter and recent paystubs as their 2008 tax return does not include a Schedule C.

An I-864A does need to be signed. From what you've said you should have checked the 24e box and NOT completed the 864A. Now you need to submit a new, properly completed I-864.

That is not what i did. I did exactly the same thing you've said in your first paragraph, by checking 24e (i remember that for sure), yet still got a rfe telling me i needed to sign i-864a. sorry if i was not clear enough.

Okay, guys, we've assembled the package. what's inside:

1) our response to rfe (explanation of what income was used for me, father's salary statement, business characteristic, business bank acccount - all overseas)+ i-693.

2) Joint sponsor info (i-864, attachment - explanation of why no taxes were filed in 2006, copy of bio passport page, 1040a (2008), w-2 irs transcript, and pay stubs 02/09-07/09)

Anything I'm missing?
