Hello,

I am looking to file for a visa for my wife we were married here in Australia. We have one joint child together and 2 (stepchildren). I would like to know if you can file for a visa or a residency. In Australia you can file for residency and they will count that as time spent in country as long as you can prove that you are still married and living together. Does it work that way with a K-3 or any other visa?

My second question is about our two stepchildren I am wondering how I would prove to Immigration that I have the non-custodial parents permission to move? Is it included in a form other than a I-130 or do I need a statutory declaration with a certified letter to prove this?

The SS# administration administers the green card or is that a separate agency. If so how long? Can you apply for that overseas or only when you actually immigrate?

The reason I ask is because my mother has brain cancer. We need to get back home at least for a little while as long as my mother is still holding on. My wife and I both need to work to support our bills here in Australia plus take care of rent plus living expenses in the U.S.

If you have lived there for more than 6 months and have established residency you can do a DCF [Direct Consular Filing] and she will get a CR-1 or IR-1.

That's the fastest immigrant visa.

You only need to file separate 1-130s for the step kids. Your bio child should have US citizenship already if you did a CRBA and the US embassy there.

Hi jasperbell_cam.

If both your stepchildren were under 18 when you and your wife got married, then you will prepare and file three (3) I-130 petitions for each of them. That also means you're paying US$ 355 x 3 (wife + 2 stepkids).

On the I-130 petitions of the eligible stepchild(ren), you must include proof that your and/or your wife's previous marriage (if any) was terminated prior to marrying her (this would mean a photocopy of divorce decrees and related documentation), a copy of the stepkids' birth certificates, and your current marriage certificate.

Does anyone know about non custodial children? I am taking 2 stepchildren with me from Australia. From what I understand they have to go under one I-130 unless the USCIS website has not been updated?

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!
