Does Medical test required for adjusting status from H1b to Green card?

Hi All, I heard this from friend of mine that medical test is required for the status adjusting from H1B. Currently I am 8 months pregnent and sending my AOS package 3rd week of this month.

As far as I know medical test is not required for the spouse of US citizens and that's required for people who apply for GC thru employment. Is this correct?

Please give me your thoughs and inputs.

08/21/2009 --- Papers Sent to USCIS

08/29/2009 --- Package delivered at Chicago 2.16 PM.

08/31/2009 --- Checks are cashed today.

08/31/2009 --- Received NOA for I-130,I-131, I-485&I-765 (Notice date : 08/29/09)

09/03/2009 --- Received Biometrics letter appt dt. 09/25/2009.

09/04/2009 --- Walk-in biometrics done today. Everything went off well in 30 mins.

09/15/2009 --- Received RFE for NABC

09/18/2009 --- Responded to RFE

09/25/2009 --- Case resumed.

10/04/2009 --- EAD Card Production Ordered

10/12/2009 --- I-131 Advance Parole approved notice and EAD Received

10/19/2009 --- Interview Letter Received for November 19th 2009 at 7.30 AM

11/18/2009 --- Interview Done

11/18/2009 --- I - 485 Touched and I-130 Touched.

12/04/2009 --- Card Production Ordered.

12/17/2009 --- Green Card Arrived and Welcome letter received.

09/16/2011 --- 1-751 Applied for removing conditions

Timeline

No, all GC applicants including those applying through a family member have to undergo a medical exam from a Civil Surgeon if you are already in the US or a panel Physician if you are outside of the US. You will need to include the medical examination with your AOS application. Since you are pregnant you will be exempt from the x-rays and can defer on updating vaccinations.

Thank you Kathryn, I read that information on the USCIS website. I have been here in US for last 4 years on H1B visa and my husband became a citizen this month and we wanted to adjust status from H1B. I am 30 weeks far now and what should I do for the medical exminations since vaccinations might not be allowed for pregnant women.

Please advise.

Your doctor will make the notation on the medical form that you are pregnant and as such the vaccinations are not recommended. You may have already had all of the vaccinations you need, btw - what you can do is see what childhood vaccinations you received and bring the evidence with you to the doctor's appointment. He will complete the form as much as he can based on your information.

Thank you. I was given Polio and TDP in my childhood but in my country (India) they won't have any records for this. I am 31 yr old now. Any how I will contact civil surgeon and discuss about this.

I am due on Sep 15th and my company told me if they couldn't find any project after my delivery then I will be out of job. However my H1B is valid until 11/2011. I am worried about my status after October. If the Civil Surgen asked me to wait until I give birth to baby for having the vaccination done. What should I do to maintain my current work status? Please advise.

I believe the civil surgeon will note that the vaccines are 'medically inappropriate' due to the pregnancy - although you should check with the civil surgeon to be sure. You are filing for AOS as the spouse of a US citizen, correct? Go ahead and file the AOS. Once the AOS is filed your status becomes 'AOS applicant' and is a legal status until you receive a decision. Apply for the EAD at the same time so you can work if you wish to and won't be restricted to working for the same employer as you are with the H1B - although as a new mother you may not want to. Once you get your green card you won't need an EAD anymore.

You may also wish to have blood titer tests done if you believe you have had certain vaccinations already and don't have proof. The titer measures the antibodies to various illnesses in your blood to determine whether or not you have an immunity to that disease. If you have antibodies, then you have developed immunity to that illness and won't require the vaccine again.
