If I am not mistaken., US use the term divorce and PI use the term annulment

They are not the same. Both are a legal termination of a marriage and acceptable for USCIS purposes. An "annulment" actually presumes the marriage never legally took place. With a divorce, there WAS a marriage and the marriage is terminated. With an annulment there never was, in a legal sense, a marriage.

Not exactly. Annulment and divorce are like Gary described, even in the Philippines. Annulment erases the marriage as if it never happened, while divorce terminates it. I think the confusion comes from the fact that, except in a few circumstances, divorce is not available in the Philippines. Except for Muslims and marriages involving a foreigner, marriage in the Philippines can only be ended by annulment.

Only two other places in the world - the nation of Malta and Vatican City - do not offer nor recognize divorce.

ic.... so what im going to use if the pre-screener and CO asked me on an interview about my fiance, annulled or divorced? since he had a decree of annulment? he is using divorced. im checking in 129f form none a box for annulled there just divorced. thanks!

It won't be a problem. USCIS and the embassy in Manila are well aware of the special circumstances for ending a marriage in the Philippines. The CO's in Manila will accept a death certificate or court ruling of annulment as proof that a previous marriage was terminated.
