Timeline

Hi

I do not know if I filled my time line in correctly there was no a facilty so I just typed the outline up?

This is all new!

This site is incredible we did not know where to start now we have a vague idea!

I have just read lots of useful info but wanted to know we plan to file AOS for CR1 should we also file the K3?

It seems that use to be the fastest but now maybe not so?

Can we just file CR1 or do we need to do K3 as well?

What would anybody advise?

AOS is adjusting status from non-immigrant to permanent resident from inside the USA. This occurs after you have arrived on a non-immigrant visa

Once again NO... You do NOT AOS (I-485) to a visa... The USC can PETITION (I-130) to determine eligibility for an alien to apply for a visa...

Or since your hubby is in the USA are you thinking of submitting AOS to GREENCARD (he never leaves the USA)?

Do I also have to file K3 or can I just do one and which is best?

So how does my husband adjust his status from VWP?

A CR1 is a visa... A visa is a document to request entry into a country. If your husband is already here he does NOT need a visa.

You can adjust from VWP by filing the I-130 (petition to determine he is an immediate relative of a USC) & I-485 (application to register as a permanent resident) at the same time. He remains in the USA until he gets the greencard

Theoretically that is all... As long as when he entered the USA and did not have "intent" to stay.....

There is of course all the additional evidence required to be included with each submission, but that is it.
