Hi everyone,

New as a memeber of VJ, but have been following the website for a while.

I am a South African living in London and am engaged to the best person I know, my perfect partner and the love of my life

We submitted out I-129f to the VSC on 27 Jan 2009 and received our NOA1 shortly after.

We registered for email updates from the USCIS and have been checking their website every day for months. The USCIS website still shows that our case is pending but we received a letter from the NVC on Sunday saying that our approved I-129f has been received and that our petition will be sent to the US Embassy in London within the next week. (which is brilliant and the best news and we're so excited!)

What I would like to know and get some advice on is whether or not we need to be worried that we haven't received our NOA2 from the USCIS and that their website still shows our case as pending? Also, will I need the NOA2 for my interview, or for AOS later?

not a surprise at all that the USCIS website hasnt changed your status. it rarely changes anything.

i believe you will need your NAO2 for the interview & im sure youll probably receive it before to much longer. if not id keep trying to call USCIS & try to talk to someone. not that they are much better than the website but maybe you will get some news. good luck!

not a surprise at all that the USCIS website hasnt changed your status. it rarely changes anything.

i believe you will need your NAO2 for the interview & im sure youll probably receive it before to much longer. if not id keep trying to call USCIS & try to talk to someone. not that they are much better than the website but maybe you will get some news. good luck!

our paper noa2 was supposedly sent out in late march

i have yet to recieve my paper noa2

my online case status just changed 2 weeks ago

they only way i knew our case was sent to the nvc was from a letter from nvc

my consulate does not require a paper noa2

but it is listed as a required document for AOS

there are plenty of people who never recieved a paper noa2

go to AOS forum and do a search

I have no NOA2 either. I found out I was approved by calling NVC. I have called USCIS and ask for them to send it. I moved a month after filing and called to change my address. I changed it online and called them, I even received a letter saying they changed it to the new address. Low and behold they kept the old address and when it went to NVC the old address was in the system. Who knows if they sent it to the old address or just didnt send one....

As far as you case showing pending, NO. The online update system is completely worthless. My wife has been here 9 months and our case still shows "pending", it is an absolutely meaningless system.

Your case is approved and it has been received by NVC. If you do not get an NOA2 in the next couple of weeks, call them. You need a copy of the NOA2 for the AOS. Congratulations. Get ready for your interview.

I believe there's a filing fee of about $350 to request a copy and from what I've been able to read from different sources we do need the NOA2 for AOS, so hopefully they will still arrive.

Looks like they aren't sending out NOA2's again. This happened for a bit in 07 when we got approved. DO NOT pay the 350$. If you call USCIS they will tell you you need to pay it blah blah blah and submit a service request (which takes months). What you need to do is call and press the numbers for an RFE. This will put you on the phone with someone from the actual service center who has access to your case. They are able to re-send your NOA2 and will normally do it for free. If they don't, just try calling back the next day and get someone else.

Whatever you do, don't talk to the normal USCIS people. I did that when we didn't get the NOA2, told them we got the NVC letter (since they were telling me I wasnt approved) and they told me that K1's aren't sent to NVC. They then sent me to a superior to recall my petition from NVC :blink: Luckily the superior wasn't an idiot, but they did tell me about the 350, which I refused to pay and submitted a service request.

I have heard SOME people submit the online approval (if you have that but not the NOA2) and it being accepted for AOS. However, this often ends up with and RFE for the original.

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

If you can prove it was USCIS fault in the lost NOA2 - you don't have to pay for it.

One way, for example, is to show you changed your address, that they acknowledged it, and yet sent it to your old one. Free NOA2.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
