Hello,

My husband is filing for me - the intending immigrant - to go to the US. We are in the direct consular filing (London) process now and need to send the affidavits of support.

My husband was living here in the UK with me, he was unemployed since sept 2008. He still filed a tax return for the small amount of income he earned while living in the UK.

He has now gone back to the USA to work. He has started up his own tree surgery business again, and this is his main income source. He is self employed.

On the I-864 it states that he has to put down his employment, then the annual income from this employment. How can he determine this if he's only been back in the US for 2 months? Does he have to estimate it? If so this would make it look like he earns more than he can possibly show on any tax returns and the numbers for the I-864 would be skewed surely?

Also, should he send in the previous two years tax returns that will show a more substantial income - or not bother seeing as we are using a joint sponsor anyway?

This is so confusing, sorry if this seems silly!

Hi,

Yes, you will have to estimate the current annual income - there is nothing else you can do since he really doesn't have any history in the business.

Yes, he should definately send in the returns from 2006 and 2007 - they do look at the overall income picture, not just the current income, in general.

My wife and I did DCF New Delhi and were working on the I-134 / I-864. I live with my older brother as our parents bought us an apartment to live together. We file separate returns. I still have to show him as part of my "financial responsibility"?

As per New Delhi website:

"The sponsor must include himself, and all individuals living in his household in the I-864. As a result, if the sponsor lives with his brother, parents, nieces and nephews, etc., he must include them in his I-864, even if they file separate returns. The sponsor must demonstrate that he can support himself, and all individuals living with him. If their income needs to be combined in order for the sponsor to meet U.S. poverty guidelines, their financial documentation must be included as well, along with a Form I-864A."

Related question: Mortgage is under our parents name. Anything to do here given that?

And if I need to show my brother, where would I do this? I have enough income to have him in my household calculation...so I imagine I do not need a I-864A...so where do I fill this out?
