Hello everyone. My brother filed his K-1 petition on Jan 2007. after the interview they said He didn't have enough evident to approve for visa, so they sent the case back to US. now He just receive a letter I-797C Notice of Action, it say:

This is to advise you that we have reaffirmed our previous decision on the above application for petition which the Department of State had previously returned for review. We have forwarded the case back to the Deparment of State for action.

and another I-797, Notice of Action. say:

The above petition has been approved, and forwarded tot he listed consulate. Please contact the consulate with any question about visa issuance or if you would like them to forward the petition to a different consulate. The petitioner can also file Form I-824, Application for Action on an approved application or petition, with this letter to request that we notifiy another consulate of the petition approval for visa processing purposes.

When the person this petition is for enters the US based on this visa, he or she will be admitted for 90 days in order to marry the petitioner and based on that marriage file for adjustment to permanent resident status on form I-485.

My question is what does they mean ? . are they approve my brother visa without interview again ? Thanks a lot every one. Have a nice day

No. It means the consulate questioned the approval of the petition. They sent it back for review. The petition has been re-affirmed, approved, again and sent back to the consulate. He will have another interview at the consulate.

Tell your brother to make sure he gather up all the information and proof of relationship and ongoing relationship he has with his fiance. I would take everything I could to try not to raise any red flags again. Good luck for him next time!

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics
