Ok, I've done a lot of research today and I have a few remaining questions.

I filled out I-864 as the petitioner, indicating that I'm unemployed and my current income is $0. I also filled in Part 7 with my savings, knowing full well that it doesn't meet the requirements but I guess that's the point of having a joint sponsor? I'm also going to include a bank letter and some bank statements for me.

I'm also typing up instructions for my co sponsor so they can fill in their I-864 , let me know if this checklist is correct:

Additional evidence needed in duplicate (get at least two copies)

- last year's tax return+W-2, or tax transcript

- For U.S. Citizens or nationals, a copy of your birth certificate, passport, or certificate of naturalization or citizenship (My question is why is this only needed for the joint sponsor?)

- letter from employer on company letterhead stating when you started, what your current position is and your annual salary.

- pay stubs going back 6 months

(assuming no bank letter/statements are needed if they make enough to meet the 5 person household requirements?)

The joint sponsor needs to prove citizenship, or LPR status, they need to prove that they have US domicile.

I have a follow up question for these Affidavit of Support issues. I'm interviewing for a job tomorrow and there is a possibility that I might get to start right away. Is it ok to use a job for current income if you've just started a few days prior? Or would they look down upon that? I'd figure I'd do some type of combination between savings and current income if I get the job that is. :whistle:

Form I-864 Affidavit of Support (by USC) with photocopies of supporting documents: This varies by each applicant so here's generic suggestions

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

(If needed)Form I-864 Affidavit of Support (by Co-sponsor) with photocopies of supporting documents:

---Proof of co-sponsors citizenship/status, ie US birth ceritificate, bio page of passport, naturalization papers, or LPR status

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

its not necessary to certified tax return copies...I have seen many cases on VJ, ppl have sent their AOS without certified tax return copies, and didn't get RFE. It's wise to get certified tax return, but an optional thing...

It's ALWAYS best to get last 3 years' income tax returns than just only last year's one because USCIS officers most of the times do ask for last 3 years' returns at the time of interview. Some may say that instructions say about submitting only last year's tax return which is true but most people occassionally fail to pay attention in those instructions that there is noted very carefully that if govt. requires more than one year's tax returns then they may. So one side instructions suggest to submit only one year (the last year's one) tax returns but on the other hand instructions do state that govt may ask more than one year if they choose to do so. And most of the times, adjudication offficers do ask 3 years income tax returns at the interivew. Thus, it's always best to submit/gather last 3 years' tax returns than only one year one. This subject has been discussed to its etnernity in many immigration forums.

Secondly, it's always best to submit/gather tax transcript than tax returns unless the copy of tax returns will be certified. Why? Immigration officers always prefer something govt. record. Tax transcripts are govt recrod and on govt. stationary; while tax returns don't say whether it's originally filed or not with IRS unless it's certified by IRS. And certifying all these copies of tax returns thru IRS will cost tons of money.

Thirdly, if a co-sponsor has filed a joint income tax returns with his/her spouse then W-2s must be submitted to verify co-sponsor's individual income; otherwise immigration officers wouldn't know how much co-sponsor earned/earns individually.

Fourth, if co-sponsor is a self-employed then the copy of ALL pages of tax-returns especially schedule C and E must be submitted along with any Form 1099 AND a copy of business license AND a letter from the self-employed person as to what s/he does and how much income s/he makes.

Fifth, a copy of co-sponsor's legal status must be attached...either a proof of co-sponsor's US citizenship or LPR.

Sixth, a employment letter must indicate since when a sponsor/co-sponsor is been working, how much income s/he makes and whether or not job is permanent or has a good prospectus on the job.

Seventh, pay-stubs must be submitted. At least for 2 months.

Eight, if co-sponsor lives in the same household then s/he would need to file Form I-864A; otherwise Form I-864.

Ninenth, bank statements or any documents of property and other things need to submitted when assets are used to meet the income requirement than income itself. So if income will be used then there is no need to submit all these stuffs except the proof of income (employment letter, income tax transcripts/returns, pay-stubs, W-2s or 1099).
