I have a question and I am wondering if someone could help. My brother in-law wants to see about adjusting his immigration status. He is the father of two boys who just turned 21. Would they be able to petition their father? My brother in law was married to their mother back in 1987 and had started the

immigration process back then. But, the relationship failed and they got a divorce, and the process was never completed. Since he was petition back before all the laws changed. Would he be able to do anything now. Please anyone help!!!! :help::help::help:

One of the 21+ year old USC sons can petition the government via an I-130. Basic procedure found HERE.

I presume the father is wanting to remain in the US (not go back to his home country) during this process - I can't answer whether or not this is something he is allowed to do (I presume he is not allowed to remain though).

You can check the USCIS timelines. It is measured in years for this type of case and that is IF there are no overstays or illegal immigration issues. It varies by country. An approved I-130 petition in this type of case gets you in line for a visa number, usually. If the benficiary is illegally in the country, maybe not.
