Hey guys....

so im trying to get a friend to be my co-sponsor because my wife doesn't make enough money above the poverty line but im not sure if its going to go through...

his IRS transcript says that in 2008 (its the only year he filed taxes) he earned 5,000 $ which is obviously below the poverty line but he has 30,000$ in his savings account. also, i have 13,000 dollars in my savings account. and from what i can see number 28 "assets of the principal sponsored immigrant" is where i could put my 13,000 down, right? can i put those down on my co-sponsors i864? is that enough money (his irs transcript, his savings and my savings) for the i864 to go through?

Certainly cash in the bank is assets. But asssets are divided by 3 for the I-864 and afmil based visas. This means his savings are valued as the equivilent of $10,000 in income...not enough. Your income and assets cannot be combined with his unless you are in the same household.

LAST year's income is not as important as THIS years (current) income. What is his CURRENT income and can it be verified? If it is enough, incombination with his assets...you are fine.

also...the instructions on i864 say...

28. assets of the intending immigrant: You may use the assets of the intending immigrant regardless of where he or she resides. The intending immigrant must provide evidence of such assets with this form. Form I-864Ais not required to document the intending immigrant's assets.

if my co-sponsor barely had any income, how much in savings would he have to have at his disposal in order to make up for that and be eligible to sponsor me? 100,000$? 200,000$? 300,000$?

They may not accept cash assets at all, we were short on the income and they wouldn't accept them even though it was way way over the amount stated!

how come the assets are divided by 3?

Because they are not income and you need to verify for them, if you do not have adequate income, three years "worth" of income equivilent to meet the requirements. For other visas (not family based) they divide by FIVE, so consider yourself privileged.

OK, and? Yes the intending immigrant can use assets to qualify for AOS, subject to being evaluated....and divided by three. You did not mention assets of the intending immigrant in your post. Assets can be rejected or accepted based on what they are. Property assets MUST be something that can be liquidated or sold within one year without adversely affecting the family. If you have ONE car, it cannot be used as it must then be replaced, for example.

To answer your other question...two people need to make $18212 per year, minimum. If you are $3000 short, your assets must equal $9000.

Same for the joint sponsor, except a joint sponsor must count the intending immigrant AND himself AND any other family members in his family size. A married couple with one child become a family of 4 and must earn enough to qualify for a family of 4.

You really should be looking for a co-sponsor who makes the rwuired income, it is so much easier. If he had no income or almost no income, he would need to have 3x the 125% amount for the family size. About $90,000 or a little less for a family of 4. (immigrant, him, wife, 1 child)

If this cosponsor would file the I-864 he would have to explain why he did have to file a tax return in 06 and 07. So be sure that he is prepared to do so.
