when u need to file for removal of conditions? i mean when ur conditional card is gonne expire?. do u hav a child together? ist preference should be try to stay together. talk to her about problems n how to solve those problems. but if its absolutely impossible gether as much proofs of ur joint residency n joint financial records as possible and file for divorce. if u can prove before immigration that u entered in this marriage in a good faith u 'll get approved without the help of any lawyer. but remember good faith/divorce waiver requires the 'final divorce decree'. if u don't have final divorce decree u can't file under this waiver. if u wanna write under 'all waiver filers out there' thread you are most welcome. take calculated steps n don't be scared if u didn't do anything wrong. good luck

If you divorce before your conditional green card is up, do you have to take any action before the 2 year anniversary of removing conditions?

you need not to do anything as long as ur green card is valid. you are legal here. just continue ur job n gather proofs of ur valid marriage. but don't forget to file ur I-751 (removal of conditions) within the window of three months period just before the expiration date on ur conditional GC. after filing I-751 u'll get extention of 1 more year to live and work here legally until CIS process ur case.

And besides reading the guides remember it will fall onto you proving that the marriage was a bonafide one, entered in good faith, if you file for removal of conditions by yourself, and that you have to have the divorce finalized as well.

If I can prove bonafide good faith marriage, what are chances of approval? my green card doesn't expire until August 30, 2010 - I can remove starting May 30, 2010. I don't think the marriage is going to work. What evidence should I focus on gathering? My wife refuses to file the papers, will I have problems with immigration if I file for divorce?

Sorry, you are not getting much help. You should be gathering together any documents that you can that show proof of a relationship. They are especially interested in documents showing joint financial/residential ties: joint lease, utility bills, insurance, assets, debts, tax returns (things of that sort). You could get notorized letters from people who knew you as a couple. Some people send in photos showing how happy they are as a couple (maybe get some from before your marriage started to break down). The same sort of items, you would have sent with your AOS application. You may want to include a statement about why you divorced.

I am sorry, I cannot really tell you, what your chances are. My guess is that if you had a bonafide marriage and can provide proof of this, then they are probably decent. If you are filing alone, due to a divorce, then you would be able to file once your divorce is final and would not need to wait until May 30, 2010.

I dont know anything about divorce laws in Florida.

Thank you Killer_Clown_2009. I was reading your previous posts referring me to a "guide" but I don't see it anywhere. I will remember to fill in my timeline.
