Hi,

My husband (US Citizen), and I (F-1 student VISA) planning to file our AOS to apply for Green Card soon in summer time. However, he got laid off at the end of last year.

I did some research online, and most of the people says, for the situation like us, we'll need to have a co-sponsor to file the I-864 with us. However, we both don't want to have the third party involved.

He used to work in Finance, so i believe he have enough saving to meet the poverty requirement. But can he file the I-864 form without any job either any co-sponsor? Is so, what are the additional requirements (specific amount of saving or properties) ?

You will need assets.

3x the amount needed for the poverty level.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, he can use assets. They are valued 1/3 for family based visas. For two people you need to earn $18,212 or have three times that in assets to qualify. Other wise it is co-sponosr, like it or not.

One note, if you the F-1 are work authorized, which many are to do things like apprenticeship, etc, then you can add your income to that of your spouse and you can provide an I-864A to add your income to your spouse.

Is now a US Citizen immigration completed Jan 12, 2012.
