Question about filing late ?

Ok, I mailed my application, overnight to VSC, but lost the delivery confirmation number. I mailed it on 05/12 and my green card expired on 05/14. Seeing as they sent me an NOA (NOA date is 05/15), I am assuming (maybe hoping), that everything is ok? Does anyone know? Can they turn around and deny the application for being late or would they have just returned the whole thing to me if they intended to do that and not process the application. Thanks!

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

You will be fine and more if they already cleared your check and send you the NOA that give you an aditional year to stay legal while your I-751 is in process.

05/25/10 - N-400 package delivered in Phoenix, AZ

06/04/10 - Check cashed

06/10/10 - NOA received

06/16/10 - Case available online

06/17/10 - Case online showing RFE (Biometrics notice) sent on 06/16/10

06/21/10 - Biometrics Letter Received

07/08/10 - Biometrics appointment

07/07/10 - Walk in Biometrics

08/06/10 - Email / Text for for new case status: "Test and Interview"

08/09/10 - Interview Appointment letter received for 09/13/10

09/13/10 - Interview Approved!

09/13/10 - Same Day Ceremony! I am a US Citizen!

Well I do not know for sure but I would imagine with them taking your money and giving you a NOA1 that they accepted it, I wouldn't imagine they would do that otherwise. Seems like the overnighting helped!

Thank you, yes the check was cashed and I have the NOA (and a few copies, that I made of it). I just suddenly became paranoid that they may grab the cash and then deny for being a day late (though it shouldn't have been). Thanks for the reassurance.

If they deny you it may be because of something else - not because you sent it on the last day possible. And very rare that they deny someone at this point unless the marriage is failing (and things of that nature). Relax. Good Luck
