Recently, my husband was trying to get some information on the US Consulate in Dubai in an effort to prepare for an interview. I filed an I- 130 in April 09. We have not received our NOA2 yet but he is trying to be prepared. He is an Indian National, however, he is currently residing in Dubai UAE. After reviewing the consulate website, he learned that the consulate in Dubai does not deal with immigrant visas. They deal with non-immigrant visas. The US Consulate in Abu Dhabi UAE is the consulate we should have listed on Question 22 of the I 130.

I contacted USCIS regarding this error to determine how I can correct this before we receive some type of action request. The USCIS employee complemented me on being proactive and requested that I now file a I 824 which is an Application for Action on an Approved Application. Our I 130 HAS NOT been approved yet so I'm not sure if we should send this in and not to mention it is $340 to file. My husband feels that it will not be needed and that the consulate in Dubai will forward our application to Abu Dhabi. I do not want to risk anything!!!! Can anyone offer any advice.

I guess maybe the best thing to do would be to send a cover letter with SPECIFIC and organized information stating information such as....

Petitioners name....

Beneficiary's name....

Date of birth's of both....

Social security # of petitioner....

when you sent in your info...

Anything else you'd find necessary....

Then write..... ____________ petitioned the I-130 for _________ and specifically on question #22 there was confusion and the answer should have been _____________. Please accept this letter as a request to have our file transferred from Dubai to Abu Dhabi.

I hope that works...that's just what I would do! :)
