Hello everyone,

So, I applied for the K-1 about a month and a half ago, but I found out today that the office I work in (an International Programs Office at a University) offers a language program, and one of my supervisors suggested him applying to the program. This would get him an F-1 visa (a temporary student visa, I think?). The program is only two months long, so that would allow him to basically visit and take language classes while waiting for the NOA2. Then he could go home and finish the K-1 process. The question is--is this even allowed? Can you get an F-1 visa when a K-1 is being processed? We're so sick of trying for the visitor visa--it's impossible to get out of Dakar, and I guess I'm just grasping for any possible option to get him here sooner.

Personally, I would try it if the cost is not a problem. I'm not sure the specific requirements of an F-1 or the possible difficulty of getting one in Sengal, but there is nothing in the regulations saying he can't apply for another visa while a K-1 petition is processing. At his interview, it's probably not a good idea to mention the K-1 petition or anything about you or having any intent of coming here permanently, unless specifically asked, as that could cause problems.

You could try asking this in the specific region forum for Sengal also.

12/01/2009 -- Embassy interview -- SUCCESS!! :)

The K1 has the intent to immigrate.

As far as I know, with an F1, you need to show no intent to immigrate. With the K1 in the system I don't know if that will be possible. On the F1 application I am sure that they are going to ask about other visas applied for or obtained in the past.

As far as I know, with an F1, you need to show no intent to immigrate. With the K1 in the system I don't know if that will be possible. On the F1 application I am sure that they are going to ask about other visas applied for or obtained in the past.

With the B-2, though, you also have to prove that you don't have intent to immigrate, and people are able to travel (occasionally) with those, aren't they? We were planning on trying for the visitor visa one more time, but I found out about this program and though this might be the better option if he has a letter from the University allowing him into the 2 month language program.

ALL nonimigrant visa require showing intent to return ... or, as stated in regs "have home that he does not intend to abandon".

A K-1 petition does NOT show that one intends to immigrate ON A DIFFERENT VISA/TRIP. It's not whether you EVER intend to immigrate, it's whether you intend to try to do so on a particular trip. One CANNOT get a K-1 visa unless one attends an interview at the proper embassy after the petition is approved, so, in that way, one could argue that a K-1 petition provides evidence of no intent to abandon home (at least until the K-1 is approved)
