I have a question about k-2 visa travel requirements. My fiancée is Filipino coming to the US. So the departure country would be Philippines marriage in the US. She has a 11 year old daughter. The mother at this time has nothing to show sole custody. Nothing also in her annulment.

What is needed in documentation from the daughters farther in RP? In order to get the visa and allow her to enter the US?

Yes the BC has the fathers name.

No, the child does not need parental consent from the father as long as she is traveling with the mother and have document that show she is the mother like NSO birth certificate of the child.

This is not true. When I had my interview I met a girl who has a 7 year old daughter (she is from VJ too) who was on a K-1 and K-2 visa. She is not married to the child's father but still the CO asked for the letter of consent from the other parent.

This is not true. When I had my interview I met a girl who has a 7 year old daughter (she is from VJ too) who was on a K-1 and K-2 visa. She is not married to the child's father but still the CO asked for the letter of consent from the other parent.

The OP is asking for travel requirements of the child and not the consul's requirement. I guess every consul is different because they did not ask for a parental consent from the father during our interview for my 11 year old daughter. I do not have full custody of my child and the father was not aware of our plans to move to another country. At the immigration in NAIA, I just presented my daughter's passport and her NSO birth certificate and we went through without any question asked. I am just posting my opinion based on my experience and I hope it will help the OP answer his questions.

Oops, sorry about that. The consul did not require us when we went to our interview.

If you possess legal Parental Responsibility, granted by the joint registering of your child with your partner, then you have equal legal status and are allowed to take the child or children abroad. However, since the passing of Child Abduction Act in 1984, it has been illegal to take a child abroad without the consent of the other parent. Under a Residence Order, where a child's residence is legally decided, you can take the child abroad for up to a month. A court does have the option though of issuing a Prohibited Steps or Specific Issues Order, which restricts where the child can specifically be taken, and the context under which it is taken. A child must also have their own individual passport, and if this procedure is made, the parent is obliged to notify all others with Parental Responsibility that this is taking place. Failing to adhere to these procedures can result in a forced separation from the child and extended imprisonment.Hope this helps..Goodluck!

As stated by Richard Bracken, "Moreover, in addition to the several forms outlined in the simple K1 system for accompanying children, the Consulate will want evidence that the alien fiancé has received the requisite permission to travel outside the country with his or her child. Usually this is accomplished with a notarized letter written by the child’s other parent indicating his or her consent for the child to travel with the alien fiancé. "
