Timeline

My fiance had an r1 visa and it was approved until 2010 in august, but she went through immigration and they took the paper they put in her passport saying she had an r1 visa. Does that mean her r1 visa is gone even tho it is stamped through 2010 ?

They usually issue the "temporary visa" in the passport, typically with every visa they send you an actual card indicating which visa you are on. I worked on an OPT (student working visa) for a year because I attended school in the U.S., I got a temporary paper and a card in the mail. I would contact and find out asap.

Does she have an I-94 card stapled into her passport? That will tell her how long she is allowed to be in the US on the r1 visa. If she thinks she has problems, she should talk to the Border Officials where she entered and ask them her questions. If she is not in the US, then she should perhaps go back to the Consulate who issued her the visa with her questions. From my reading on the r1 visa, it is not supposed to be removed from the passport at all.

Where is she currently? In Canada or in the US? If she is in Canada, then they would have removed the I-94 card when she left the US. The r1 visa, however, should still be in the passport. When she re-enters the US using the r1 visa, they will put a new I-94 card in her passport. The I-94 will tell her how long she is allowed to remain in the US at that time. she is currently in canada, she claims she never got an r1 passport just a stamp saying her visa is good until 20010. If she were to come back does she just go to the airport and saying she has work again in the states and get a new entry exit visa card or does she need to gather a letter from our pastor saying there work that she needs to do down there ?
