Hello everybody!

I am new to this forum and do not orient well here yet. I am sure my question was asked million times but I just do not know where the answer to it is on this forum. I apologize for this repetition in advance.

My situation is the following:

I am on F1 student visa in the USA for several years, I met my husband here and we got married. He had a green card then. Now he became a US citizen and we need to file documents for me.

Maybe my question is stupid, but I am totally lost in the ocean of immigration information. Do you have a list of forms I need to file in my case? From what I found, i have to file

I-130, I-485, I-765 (optional), G-325A (for husband), G-325A (for wife), I-693, I-864

Did I mention everything or missed something?

Do I send all this papers in one package or in what order?

Do I have to send one money order with all fees or separate?

What documents in addition to the mentioned forms I need to submit?

Do I have to send it to Chicago office, dont I?

When can I stop maintaining my F1 status and not fall out of legal status in the USA? I am finishing my study (and my status will expire) in May 2009.

Movint this to the other forum, AOS from Student/Work/Visitor visa.

I-130 and 2 G-352As attached.

I-485 and another G-325A attached.

I-864 and financial evidence attached

I-765

I-131 DO NOT attempt to travel and return with just a F-1 visa, you need AP document in hand. Also if you overstayed a visa by more than 180 days do not attempt to travel with AP wait for green-card.

Also passport photos for each.

12/10/08 - Sent I-130/I-485/I-765 from VWP

12/16/08 - Received

02/13/09 - I-765 Biometrics

02/17/09 - I-485 Biometrics

04/23/09 - Interview - Approved!

04/27/09 - Card production ordered

05/02/09 - Welcome to America letter

05/06/09 - Green card received!

I am sorry for a mistake in my last post. I have not noticed that YuAndDan mentioned I-864. I see this form I-864 is included in the list. But form I-693, which is a medical record, is not among the documents. Do I need to submit it later?

Summing it up, the original package must include:

I-130 with two G-352A

I-465 with one G-352A

I-864

I-131

I-765

Is it right?

I do not see the form I-693 in this list.

But in the checklist for the form I-465:

I see the form I-693 is included in this package. I am confused.

Do I do medical examination BEFORE filing all the papers and send medical record (when it is done) TOGETHER WITH I-465? right?

what about I-693, I-864. Do I need them or not?

YES :yes:

You need a full medical including vaccinations in-order to immigrate "I-693"

And you need a sponsor, The person who filed the I-130 your spouse. "I-864"

Note I-485 says you MAY include I-693, if you dont, one of 2 things happen, you get an RFE for it, or you will be requested to bring it to AOS interview.

I got additional questions as I started to fill those forms. Here they are:

1) Now I am in F1 student status. I am not sure if I have an alien registration number. I think I dont have it. At least, I do not know about it. In some forms I have to write my A number. What should I write? "N/a"?

2) My husband has recetly got a US citizenship. When he had his green card, he had his alien number. But now he does have it as he is not a green card holder any more. What should I write when I am asked about his A#? "N/A"?

3)form 485, part 3

Does this part ask questions about the time when my visa was issued or now? When the visa was issued I had my maiden name (now I have my marital last name and use it everywhere and fill all immigration documents using my marital name), I had different marital status.

I also came on J1 student visa (without 2 year rule), then I changed my status to F1 and continued to study for several years being an F1 student.

The question in this part asks me about my visa when I entered the USA. I entered on J1. Then I changed it to F1. So, I should write J1, correct? I am afraid they will be so confused there.

Please, I need your advice!

your A-number is your alien registration number and you do not have it yet, leave the space blank, that's what I did on the I-485 and on the I-130 I wrote 'n/a'

For your husband, as he is now a citizen I think you put 'n/a' where it asks for his A-number because question 13 on the I-130 form asks how he became a citizen and he can put in his date of naturalization there.

For part 3 on the I-485 where it asks the status you were in at your last POE I put 'student', I don't think that you have to write the specific visa as you will be attaching a copy of your F-1 to this application.

I got more questions with my papers:

1) My husband got his US citizenship through naturalization. He was not born in the USA. I thought that the birth certificate/passport/certificate of naturalization is needed to prove this US citizenship. But he is not a citizen by birth. So, will the copy of his naturalization certificate be enough? Or I still need the copy of his birth certificate + translation.

He does not have a US passport yet. Do we need to make it first and then do a copy of it and only after that to send AOS package? Is it enough to provide just a copy of his naturalization certificate to show his US citizenship?

2) when filing i-134 (financial affidavit). He has always had a full time job, in 2007 he worked on a contract (self-employed) for a year, after that he got a full time job again (from 2008). Now is is a full timer from August 2008. What documents does he need to support i-134? Employment letter, bank statement. For what period of time?

I'm not entirely sure about question 1 but I would think that the copy of his certificate would be enough. There's a space on the form where they ask you to write the date he became naturalized and the certificate would be proof of that.

I didn't file the form I-134.. I'm not sure why you need to? We filed form I-864, I'm not entirely sure about this but it looks like form I-134 is for a sponsor other than your spouse.
