Hi all,

i recently received a form in the process of my AOS, i accidentally put in my timeline that it was an RFE, but when i was looking at it today and re-submitting my forms to DHS, the form is actually a request for INITIAL Evidence.

Has anyone ever got this form, as opposed to a request for further evidence form? Im assuming they are not the same, please correct me if im wrong.

If they are different, is it bad at all??

I think on VJ we tend to call anything you need to send back an RFE. But the initial evidence isn't better or worse in my opinion than further evidence. It just means something you needed from the get-go wasn't included to make it a complete application. It should be fine if you took care of it. Just follow up and make sure it starts processing again once they receive it.

VJers tend to latch onto terms, not that its a bad thing necessarily, and there really is no difference. I think most of us interpret "RFE" as "Request for Evidence". Whether it is intial, further, etc., is not important. In fact, a request for initial evidence would worry me less because it means you just left something out. If you sent them all you had and they asked for MORE...then I would worry.

Excuse my french (is it an american idiom too?? I know it is in the UK) but I believe that the difference stands in the fact that if you get a RFE they already started to process you case and needed "more evidence". However, the RIE underlines the fact that they didn't even bother opening your file since "initial" evidence was missing. In short, I think RIE is worse as it seems to delay your application a bit more.

Can I ask how you found out that they didn't start processing your EAD? Thanks!

Yes certainly! The letter i received in the mail said something like ( i had to mail it back with my documents so i don't have it on me) "...once we receive your documents we will then process your I765-if applied for-within 90 days..."

Which means the 90 days starts all over again from when they receive it (hopefully monday!).

Yes certainly! The letter i received in the mail said something like ( i had to mail it back with my documents so i don't have it on me) "...once we receive your documents we will then process your I765-if applied for-within 90 days..."

Which means the 90 days starts all over again from when they receive it (hopefully monday!).

Yes I got a RIE as well two weeks ago. I mailed it back and my status updated as "On May 19, 2009, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done."

My fingerprints were taken already so I am hoping that they actually started to process my file and will complete it soon!! I am highly frustrated because they needed my birth certificate translated...which...I had submitted with my file. It was an official european birth certificate translated in 14 languages or so provided by the french government...I think the IO didn't even bother looking...

Do you guys think I can expedite my case by proving them that I actually submitted what was requested and that on their side they screwed up? If so, how can I do that?

Well if you have submitted the info they needed, i dunno about expediting, as long as they have it and thats the ONLY ting they were asking for, you have no reason to panic :) I too have already had my fingerprints before i received the form so im hoping at the very LEAST my I765 will be processed quicker.

But as long as thats all they are asking for im (sort-of) happy to wait, sigh...

I just want to be able to live like a normal person with a social security, job, license, etc etc!

Agreed - My only frustration comes from the fact that I have several jobs lined up and they are waiting on me...I wouldn't like them to turn me down because my EAD took too long to come...
