Myself and my fiance are preparing the I-129F package for the K1 Visa. Upon reading the checklist of things to send that is listed on VJ, it says we need to send photocopies of each page of the US Citizens passport - with a validity of 5 years. Does this mean my fiance's passport has to have another 5 years left on it before it expires?? Or does it mean he has to have had it already, for 5 years? His passport expires in 2012, meaning we only have 3 years left on it! What should we do??

You only need to send in copies of the USC passport if they don't have their birth certificate. And the passport has to have at least 5 yrs left on it I believe.

Your good to go - means the length of time it was issued with.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The US citizen prepares the I-129f. Passport can be used for verifying citizenship, but so can a birth certificate and the instructions say the passport must have "been issued" with a validity more than 5 years. This means an ADULT (10 year) passport. Passports issued to people under 16 are valid only for 5 years (but are half the price). So, for example, if your fiancee is 19 years old but got her passport but got her valid "child passport" at age 15, it would not be valid as a means to establish citizenship. If she was over 16 when the passport was issued, it is not a problem, as long as it is still valid and not expired when she copies it for verification of citizenship.

A child passport is valid to show evidence of travel and she can use her birth certificate in any case.
