Hi,

I have a conditional green card which would expire in few more months. I have to apply to remove the conditions. On going through the form I-751 i realized that we need to report any change of address thru' AR-11 and I-865. As me and my hubby were not aware of the existence of these forms, we could not sent them earlier. We moved to this new address a year back.

I'm scared, i dont know what to do now. The I-865 had to be sent 30 days after address change. But it is has been a year..

Can i have my hubby still go ahead and send the I-865 with the effective change of address date as last year.

Will there be any problem??? .. Please help

Change your address now, you should be fine.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

File them NOW, ASAP.

AR-11 needs to be filed within 10 days of moving and I-865 within 30.

This is explained on your welcome letter when you got your green-card, so you cannot use the excuse that you were unaware.

I have yet to see someone report having problems filing this late.

Can i give the change of address date as last year's date..

No, date the AR-11, and I-865 as current filing date, however on the forms indicate the correct date of move.

I'm sorry.. do you mean i have to enter last year date as my move date in AR-11 & I-865 forms??

These forms have an entry for "Effective date of change of address"..

I filed my AR-11 when I moved but also did not know about the I-865 until the ROC process. We had no penalty with the late filing of the I-865 thank goodness.

Follow the advice you were given and file ASAP and include a copy of the AR-11 confirmation in your I-751 (if you have not already sent it). As for the date, yes, put the date you moved. It was effective then. If you put today's date it would be lying and that's a no-no.

Hi Tasneem,

Don't worry too much about AR-11 and I865. Even if you dont file them now but send them alongwith your I-751 application you will be fine. Most important is conditional resident's change of address i.e. AR-11. USCIS is more concerned with resident and not USC (US Citizen) Spouse's change of address.

I didn't do AR-11 but when I filed for I-751 I did online AR-11 and then I-865.

So do this please. Do Change of address online see link below.

After you submit the form you will get a confirmation page. Print that page as well as save it as PDF (If you can).

So you will be covered.

Now when you file for I-751. Attach I-865 and mention in the cover letter that you have attached I-865 (Change of Address of USC spouse) and confirmation page for your change of address AR-11, that's it.

Another member on VJ acted on my advice without any problem at all.

No need to worry too much. Important thing is that you do AR-11 online, save the print out and file I-751 no later than 1 month before your GC expire. You can send I-751 2 days before your GC expires but it's always better to file before you GC expires what if they reject your application for some and then you will no time to refile.

So file no before 90 days of your GC expiration but any time within your 90 day window. e.g. GC expires 04-01-09. so any time from 01-01-09 and before 04-01-09 is.
