Hi!

I am sending my AOS package today (I-130, 1-485, G-325A, I-693, I-765, and I-864)

I am attaching two checks: one for $355 and another for $1,010.

My wife and I are currently in the U.S.

Do I need to add a $70 check payable to the Department of State for the I-864???

04/12/05 Engaged!

08/06/05 Moved in together...

08/06/08 Got married!

05/19/09 Sent AOS Package (I-130, I-485, I-693, I-765, I-864)

05/20/09 USCIS received AOS Package 10:43 am

05/26/09 Received NOA for I-130, I-485, I-765

05/26/09 Received biometrics appointment for 06/13/09

06/13/09 Biometrics taken for I-485 and I-765

06/15/09 Notified USCIS of incorrect name spelling

06/20/09 Received letter from USCIS- name corrected

06/27/09 Received Interview Letter for 8/13/09

07/12/09 I-765/EAD approved! (online)

07/16/09 Received EAD!

07/20/09 Applied for SSN.

08/05/09 Received SSN (mail).

08/10/09 touch (I-485, I-130)

08/13/09 Interview...Approved!

The $1010 paid to USCIS for the I-485 also covers the I-864.

NVC is NOT handling the I-864 as in the case of an IMMIGRANT visa so you dont pay them anything.

Moving this to the OTHER AOS forum, it looks like you are NOT adjusting from a K-Visa if you are including an I-130.

Cali - We are in the same boat, we are going to be mailing out our forms tomorrow afternoon. From my understanding from the website it looks like we need to pay $70.00

This is what the website says:

Filing Fee :

Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad.

Anyhow my wife and I are looking at your post and notice that you are submitting a I-765. Make sure to send $340 for this form.

05/17/09 - 05/21/09 - Preparing papers - (i-130, i-864, i-485, i-765, i-693, g-325a).

05/22/09 - Mailed out papers (Priority Mail - since its Memorial Day Weekend)

05/26/09 - Papers delivered @ 9:06 AM and signed in Chicago by JH

06/03/09 - Checks got cleared after 8 days.

06/05/09 - Received NOAs for I-130, I-485, I-765, I-131

06/12/09 - Received BioMetrics letter. :) Hurray!

06/31/09 - AP Approved

07/01/09 - EA Approved & Card production ordered

07/06/09 - Received AP

07/08/09 - Interview Set for 08/20/09

08/20/09 - Interview and got APPROVED

Wrong What NVC is saying is if the I-864 is being handled by NVC domestically as in an IMMIGRANT visa case, you pay them the $70 when the request the I-864. NVC is NOT USCIS. USCIS does NOT change a fee to process I-864.

AND WRONG!! The FEE for I-485 also pays for I-765 when I-765 is based on pending I-485.

NOTE: If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, no fee is required to also file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485 as of July 30, 2007.
