im confused with this....

my fiancee have 1 full time and 1 part time job.. and his monthly military drills (because he is a reserve).. BUT comes MAY 2009 he was activated and now a full time military personnel ...

so my question is...

will he get a letter from employer from his 2 jobs?

or

will he just get the letter from the military??

I guess that depends on whether or not his civilian employers are retaining him in his current postion AND if they give letters of employment (as I've heard, some do not.)

So, no one here can answer that question.. only your fiance's employers really can :)

I'm not aware that a person is required to have a letter from their employers for the i-134. You might want to wait for someone elses advice but the form itself doesn't ask for a letter from an employer mearly your current employment information.

If he's no longer working at his full and part time job than it would be incorrect to include them as his current employment.

just to note:

If he's no longer working at his full and part time job than it would be incorrect to include them as his current employment.

If he has been granted a sabbatical (or leave or whatever they call it when promising to retain his job), then a letter of employment might well be a good thing to have .. I would assume :) If they (particularly the fulltime employer) is willing to provide one. :)

That letter you are talking about is for the affidavit. Yes I gess to prove employment and how much money someone makes a letter is needed. I think it will bepend if the full time position is still retained. As long as he in on active duty he is only making money from the military service. The only thing he can do is try to get the letter and maybe get one fro the military service.

Employer letters are optional (for the petitioner and the employer) but he can ask. Most states have laws requiring he be re-instated if he is called for military duty, so that in itself, would not prevent them from writing a letter. If he is currently ACTIVE duty military, he is not required to meet 125% of the poverty guideline...only 100%.

However, all that said, the I-134 (I assume it is what you mean) asks the question about "current income" in the present tense...the day he fills it out. If on that day he is active military, the correct answer to "current income" is his military pay only, UNLESS, I did work many years for an employer who, at their option and as a benefit for employees, make up the difference between military and regular pay. A very generous benefit, but not unheard of among big companies. If this is the case, then this should be included also, along with documentation of the fact.
