My mother claimed me as a dependent on her tax returns. She made like 21,000 thousand which is a bit short of the requirements for a household of 3 people (her, me and my husband).

I make my own money and can prove that my income, added up to my mom's, is above the poverty line for 3 people.

But can I do this? Wouldn't my being claimed as a dependent negate any money I make? Please help me...

yes... you prepare the I-864 and mom can fill out the I-864A

Is payxibka correct in assuming you live in the same place as your mom?

We are not living in the same house... How does this matter?

Oh, I just read this on I-864A about who can be considered a household member:

"A relative or other person whom the sponsor has lawfully

claimed as a dependent on the sponsor's most recent Federal

income tax return even if that person does not live at the

same residence as the sponsor;"

So it doesn't matter whether we live in the same house. Right?

Your mother is not the sponsor. You are.

Is mom's income for this year 21K? You are earning only 5K this year? Not year to date, but annualized.
