I am an australian citizen, i recently married my husband (USC) and we filed for family-based green card.

Forms I 864, I 485, I 765, I130, I 131, G325, I693. i received receipts for my forms, and have already done fingerprints.

My husband is currently unemployed, has been since May 30, 2008, however he does receive Unemployment benefits.

We have a great amount of money in our saving (i transferred a lot of my aust. money here), close to $20 000. We also have just under $8000 in our checking.

My husband has filed tax returns for the past 3 years and we included them. His total income of Unemployment is around $17 650. On the poverty guideline sheet it says you have to be earning more than $17 500, which he is.

We just received a letter stating we did not meet 125% of the federal poverty line!!! So now we have no idea what to do.

We could ask his mum, she lives here too (USC) but not in the same house as us. HELP!!! what are our options??

Ours is well and truly a real marriage and i just want to be able to live like a normal person in this country!!

Is there anyone in the same situation?

It shows that he needs to make $18,212 for a family of 2. Did you list your assets on your original I-864? You should be fine with the unemployment and the assets.

Thanks for the reply. Yes we did list our assets on the original filled out form, along with his last 3 years tax return. Our only assets are our savings and checking accounts.

I did however just ring uscis direct and they said my husbands mother can also file the I 864 along with him as a joint sponsor. She makes well above the poverty guideline.

I was confused as the poverty guideline form on the uscis website says he needs to make only $17 500 for a family of 2? Was there another form?

The threshold is 125% of the poverty line.

Having a co-sponsor will work just fine. Smooth sailing ahead. :)
