I had another post concerning my approved packet being sent back to USCIS by NVC. I went ahead and called NVC back and they told me that I had some missing information on the I-129 Part C area where it asks about question 2. Have you ever been convicted by a court of law......., I thought that pertained to military service for some reason and I left it blank!!!!! My question is how did USCIS overlook this and approve my petition!!! What is my next step?? Should I send in another revised I-129 to USCIS or wait for USCIS to send an RFE??? Of course the answer to question 2 Part C is NO, but I forgot to check it. What should I do?? I was told that NVC send back the packet on May 11.

an RFE was supposed to be issued for this, workers that work at USCIS are humans too and they do make mistakes so maybe thats why it was overlooked... just wait for USCIS to get it and call them to follow up, mostly likely they will issue an RFE this time...

Yeah - that catches a lot of people.

I would wait for the RFE, because you don't know exactly what they will send back (they could send your entire package back!).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Number should be on your NOA 2
