Advance parole-Do we need to file with AOS?

My husband has a k-3 visa. We will be filing the AOS this month. His K-3 does not expire until 07/2010. Do you guys think we need to file the advance parole?

Please read page one of form I-131 directions.

K-3 do not need AP in order to travel, the K-3 is multi entry visa which allows travel.

If K-3 is getting close to expiration you can file I-539 to extend the K-3.

Thanks. We will not be going anywhere in the next year. I was just afraid if the AOS was not approved for some odd reason until 07/2010 or after we would need the advance parole. Can anyone forsee this happening? What would you do?

Again K-3 does not apply for advance parole, they file an I-539 to extend their visa.

I have see a few K-3's delay filing for AOS until they are closer to 2 years of marriage, if AOS is approved AFTER 2 years of marriage the resulting green-card is 10 year un-conditional, this saves from having to to the added paperwork of filing an I-751 2 years after getting a 2 year conditional green-card. In this case sometimes AOS can take longer than the validity of the K-3 visa.
