I have already finished the i-129f and am currently doing the AOS part. My boss met someone from Seoul and wants to get married but wants to know the best way possible to do it and so is meeting tons of atty's and finding the best route. I already know the best route is to do it the legal way and the quickest way is the i-129f.

My question......

He is set on getting married July 19th. There is no way I can send out all the forms for him and have his fiance approved and over here by then.

Can he go to Korea and get married there (just a small ceremony) and come back and start the i-129f process....or even start the process right now and while he goes for just a visit over there, get married, and continue on with the process. Will is hurt him/her? Does it really matter?

I wouldn't think there would be any problem with this but thats why I ask.

Since this is in the K1 forum...I'm guessing when you say "start the I-129F process" you mean apply for a fiance visa. No, your boss can not get married on July 19th then apply for a FIANCE visa since he would be MARRIED. Nor can he start the process now while engaged and continue with the processing of a fiance visa after he is married. Advise him to either (1) postpone marriage and file for the finance visa or (2) marry then apply for a spousal visa (K3 or IR-1/CR-1).

Hey,

The best way is the K1 visa or the K3. Like you said he can't get one of these visa before july, because the BEST scenario would be visa in hands november.

If he begins the K1 process and go to visit her he can't get married because He applied for a fiancé visa. If he wants to get married in her country he can't apply now. He has to wait, get married and apply for a K3 visa.

Or he goes over and has a wedding ceremony if that's not legally binding. Obviously that is fairly risky and I wouldn't recommend it or do it, but your boss seems kinda demanding, so you may want to mention it. If he wants to get married, then do CR1 or K3. Last I heard CR1 is running around the same time as the K3 and then his wife would have a greencard upon entry, therefor saving YOU the paperwork for filing AOS :)

yea...he told me he just wants to go over there and have a pretend wedding pretty much. no legally binding papers....nothing like that. just a ceremony that the family can say they were at. there will be no name changes, no adding each other to anything, nothing legal about it. i discussed with him though that if he went and legally got married, signed any papers binding them, that he and she face life time bans and fines.....

so the warning was given.
