Hello:

We filed the i-130, i-485 last may. We got an I-797C notice of ASC Appointment letter for biometrics, which we attended. Then we had our interview in philadelphia in February, in which the person we talked to said that she was going to reccomend this case for approval. However, it is now may, and my EAD expires in september, so I would have to renew it in June. However I NEVER recieved the notice of ACTION Receipt. All I recieved is the I-797C, so what can i do? Do I have to file the renewal of the I-765 EAD autorization with the fee? Or can I submit a copy of the cashed check as proove?

Also do you know why it is taking soooo long to get the approval notice. I did set up an info pass appointment in march, only to be told that it could take years to process, and the first person should never have told me that it would be approved, because it has to go through alot of checks before they can approve it.

Its will be a year since we filed at the end of this month. How much longer can I expect to wait, for this to be approved, and is there anything else I can do, to speed this up??

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

1. Contact a congressman 2. INFOPASS so you receive a copy of NOA 1 (I had the same situation with NOA1 as some smart #### in USCIS did not put my firm's name on the address and of course it was returned). You will need to insist that they do the service request and give you a number of it (otherwise they will not enter anything in the system).

What do I tell them at the info pass appointment for me to get what I need, and what do I need??

No we haven't moved at all. I was just told by the Infopass person that there was nothing they could do, when I went before. They said their hands were tied until they got notice that it was approved...

Is this an abnormally long time for this type of case to be approved?

It seems like a long time; although you are like 3 days short of 90 days, which is usually the time they have to do 'something' -- as in "touch", send RFE or something. While on the interview, did they tell you you would be put under Administrative Processing or something?

No, the person who did the interview told me that she was going to reccomened that this case be approved. She never mentioned anything regarding adminstration processing or the like.

We went back a month later, and had an info pass appointment, only to be told they could do NOTHING because the case was still showing as pending.

Ok so since we had the interview already, you suggest makinga nother appointment, to see if they can provide a copy of the NOA1 so that we can renew the EAD, for another year without the fee? Also I guess the smart thing to do while there is to inquire about the case status of the 485??

Absofvkinglutely brother. Make the appointment to at least inquire about ####### is going on. I don't know if they will extend your AP/EAD, but make that appointment asap.

I agree - I believe that since you paid the $1010, you have the right to unlimited extensions of EAD as long as your case is processing (no GC yet). I think that was one of the reasons why all prices went up and their explanation was once you pay the fee you're good until you get your GC. Don't quote me on this I think I read it right before the fees will skyrocket.

Just a quick question...At our interview, the IO kept our I-797C Request for Applicant to appear for initial Interview letter( I-485 ). Is this normal? We made copies of it before the interview, but they kept the original and never gave it back to us. Will we need that document later on?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.
