BIG SURPRISE !!!

Today evening when i checked my mail.....i found something interesting...i received a ''interview letter'' from USCIS....the contents in the letter is as follows:

- Original and copy of each supporting document that you submitted with your application.Otherwise, we may keep your originals for our records.

- If you have ever been arrested, bring the related police report and the original or certified final court disposition for each arrest , even if the charges have been dismissed or expunged.If no court record is available, bring a letter from the court with jurisdiction indicating this.

- A certified english translation for each foreign language document.The translator must certify that she is fluent in both languages , and that the translation in its entirety is complete and accurate.

2. she already reached more than 125% of poverty guideline around $32k on april 15th 2009......she still needs to get a job before v go for interview...........

3. do i need to have a co-sponsor n if yes, va is the procedure ...........

Did you submit this in your intitial I-864?

- Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 months;

If you didn't, you will need to. Since your job lost will affect getting this if you need them, you will either need to get a 1) co-sponsor, 2) a new job that covers the level needed, or 3) assets to cover the difference in income level to meet the poverty level needed. (unemployment counts as income).

To get a co-sponsor, they will need to fill out I-864 for the sponsorship. Same instructions when your wife filled out hers.

Assets - I-864 FAQ

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I am thinking of following you.

My wife already earned gross salary of $32,000 this year(till april 15th 2009....she got severance package for 3 weeks as well) and my wife is thinking of applying for unemployment benefits before going for interview...is that ok ?

i hope she shud get around $240/week in unemployment benefits.

My wife need to fill new I-864 before going to interview right.......or does she need to send it to USCIS again as i send it before with AOS ?

You will be attending interview one day before mine......if u have any advice 4 me please send me.

sorry,i cudnt get you.

In my initial evidence i sent my wife's 3 years tax returns(2008,2007 & 2006) on march 5th 2009 with my AOS.

We filed MFJ in feb 2009.

I dint know that she gonna lose her job in april.

Till april 15th 2009 she received $32,000 in earnings and she is planning to apply for Unemployment benefits soon.

she may get $240 per week. she is having around $35,000 in savings n cd's.

If she doesn't get job by May 27th 2009(my interview for I-485)......will this b ok ????

She will have to show evidence that she still maintains the income level for your case.

Will she make enough with the unemployment?

I would recommend that you don't tried to hide your current job status/income level.

If you don't make enough, a co-sponsor is recommended.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

if i may ask, when you first started your process, were you already in the US?

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

Hi all! Immi_007 we have the same interview date. Mine is May 27..next week! I am in the same boat as you but not sure how to handle it.

We sent all our applications Dec '08. My wife (USC) was the sponsor and had a good job and sent all employment letters, pay rate, etc..in Dec. Now, she is not working, she lost her job due to economy. And I just received my EAD card and having no luck in finding jobs. My wife cant find any jobs as well, but she is getting unemployment (about $400 weekly). We have PLENTY of finances well over poverty guideline combined in our checking & savings, CD, and my wife's unemployment checks.

Will this be enough for the interview next week or do they need to see current money coming in from employer? Also, do I need to fill a new I-864 in this case? Do I hand this to officer or wait till he/she asks for it? Sorry to sound like a broken record, but would like to know what track you guys are going or went through already.

Well, the I864 is SUPPOSED to be interpreted as it was on the date it was sent in. That's the rule adjudicators are supposed to follow.

BUT it's possible the officer could ask (at interview) if the financial circumstances have changed.

I would go to the interview with proof of her earnings through the date of the job loss.

If the officer decides that (due to the change in circumstance) a joint sponsor is required, they will "RFE" your case till another is found.

I think it is going to be interesting to see what the results of these situations are in this economy as it relates to immigration. I do hope OP's will come back to threads and let us know what happened. There are a lot of people in this situation right now. It would be good to have anecdotal evidence to give us clues as to how others can move forward.

I am taking all the originals of the photocopies submitted to the USCIS for AOS in MARCH 1st week.

I will carry one set of photocopy as well.

About the income, i will carry last 2 months paystubs she received till april 15th 2009(the day my wife lost job).

She applied for Unemployment Insurance and v r taking the statement vich v received from DES(dept. of economic security).

My wife dint receive the payment from the DES yet 'coz she received 3 weeks severance package.

Till april 15th 2009 v reached the poverty guideline already so i hope there wont b any problem.

v filled new I-864 form stating the present status and v will not submit unless asked by IO.

I think its not necessary to reveal anyhting if they dont ask us.

I dont know what happens in Interview......lets C.

Good luck today with your interviews. We had our interview today. We did tell the immigration officer that I lost my job. She only asked if I would be able to return to the same job later. I told her that I wasn't sure, but I was looking for another job in the meantime. She did not ask for a new I-864, check stubs, unemployment info. Nothing.

I hope that you have similar experiences immi and jojo.

Our interview went very well! It took about 10 min. and about 5 of those minutes was the officer talking about himself. He asked main questions of how we met, address, DOB, parents name, marriage date. He then asked what joint docs we had and we handed him our recent tax documents, joint cell phone, affidavits, and marriage certificate. The officer mentioned that everything looked very good, background checks were clear and will mail the card out soon after he reviews the documents we just handed to him. He didnt mention about I-864 or current work status. It was very easy and he was a great friendly officer!
