I entered the U.S. last September on K-3, and I finally sent off my AOS documents on April 3.

The USCIS received my documents on April 6, and the check ($1,010) cleared on April 14.

I am kind of worried about a biometrics schedule.

I will temporarly leave the U.S. with my husband to Korea at the end of May, and stay there for two months.

I don't want to miss the date for biometrics.

I haven't received NOA yet.

How long does it usually take to get biometrics done?

And is there anything else I need to do before an interview?

And how long does it usually take to have the interview?

Thank you very much, VJ.

I think if you leave the US with out Advance Parole or GC, they will not allow you back into the US. Someone else might be able to expand on this.

  • Average time from NOA1 to biometrics is 29 days.
  • Average time between biometrics and interview is 138

Source and more data

My understanding is that you will not be admitted back into the US without your advance parole document. The K1 visa is a one time ONLY entry document. Even with the advance parole document, it is not a guarantee. It simply allows multiple entry assuming you have not committed violation of the law.

My wife and I are in Cebu City pending green card approval and we do have the Advance Parole document. Our plans are to return by the end of May. I am still nervous about returning. We are in the Philippines for medical treatment for her. I have someone watching my mail daily in case I receive any communication for USCIS. Our case was transferred to CSC which usually means you will not have an interview. Please, do not leave without your advance parole.

If USCIS corresponds with you while you are out of the country and you do not respond within their time frame they will cancel your case and you will lose the money that you paid for AOS and on top of that you will be denied re entry and then you will have to start the whole immigration process from the very beginning.

Good Luck!

I don't think I need to get Advance Parole (Travel Document).

In the Application Form for Travel Document (I-131), it says:

"If you are in the United States and wish to travel abroad, you do not need to apply for advance parole

if both conditions described below in A and B are met:

A. You are one of the following nonimmigrant categories:

3. A, K-3 spouse, or K-4, child of U.S. citizen

B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your behalf

and is pending with USCIS"

Also, the Department of State website says(http://travel.state.gov/visa/laws/telegram...grams_1431.html):

"According to the USCIS rule, "aliens present in the United States in a K3/K4 nonimmigrant classification may travel outside of the United States

and return using their nonimmigrant K3/K4 visa, even if they have filed for adjustment of status in the U.S. prior to departure

The Service will not presume that departure constitutes abandonment of an adjustment application that has been filed."

So, I thought I do not need to get Advance Parole, and I didn't filed I-131.

This is my understanding. Is there anybody clarify?

Do I need to get Advance Parole to return the U.S.?

Thanks, VJ.

Your correct. A K3 does not need AP for travel. A K1 does.
