Hi everyone,

If I have a joint sponsor, do we have to pay the $70 twice?

$70 for my affidavit and $70 for the joint sponsor?

And to what name does the check have to be??

Oh my gosh!!! We have a joint sponsor too, and I didn't even think about that. #######, we sent out our AOS yesterday with a check for 1010.00. Now I'm worried, should it have been 1080.00??? Oh no, hurry someone answer, I'm freakin out now. :unsure:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi Bobby

checking this site http://travel.state.gov/visa/immigrants/in....html#forms_fee it seems like they wont send the AOS package back, but they will send us a bill for $70.. Does Immigration bill you?? If they have to send a $70 bill that's absolutely fine!! But please we hope are not going to send it back.. Such a waste of time!! And we've been already waiting for such a LOOOOOOOOOONG time now!!!!!

So if you have a joint sponsor you have to pay $70?

KK if it's so.. We didn't find anything that is talking about any additional fee. We just saw the possibility to submit another 3 years of federal tax and another I-864 for a joint sponsor but we just checked the instructions again and nothing, nowhere is mentioned any additional fee of $70.. oh my GOSH.. we're going crazy now...

I-864 requires fee.

I-864a does not.

I found this in

DEPARTMENT OF STATE

22 CFR Part 22

[Public Notice 3407]

Schedule of Fees for Consular Services, Department of State and

Overseas Embassies and Consulates

AGENCY: Bureau of Consular Affairs.

ACTION: Final rule.

This new AOS fee will be charged only once for essentially

duplicative I-864 forms filed in support of additional members of one

family, made up of spouse, parents and minor unmarried children; even

if each member of the family is being processed individually for

immigration to the United States or if the family member may have had a

separate immigrant visa petition filed on his/her behalf.

The Department will assess one AOS fee for each distinct I-864 form

submitted, whether it is filed by the primary sponsor or by a joint

sponsor. No AOS fee will be charged for co-sponsors filing I-864a

forms. If more than one I-864 form is needed to fulfill the

requirements of the law, the Department will assess one fee for each

separate affidavit. A new AOS fee will be assessed if a new I-864 form

is required in support of any application for immigration (for example,

when a joint sponsor is needed for an application that has been

rejected due to section 212(a)(4), inability to qualify under the

public charge provision of the Immigration Act). The AOS fee is non-

refundable as it is a processing fee.

I am looking for an update on this rule. NVC will send you a bill for immigrant visas. I-864 Fee NVC

This is an interesting question, I never thought about this.

Thanks so much for helping. We didn't think about this either as we never saw it come up in the forums as regular conversation. We didn't fill out the I864A but two I-864's (my sister didn't care about doing the I864A agreement). It honestly never occurred to us about seperate fees, and information about this isn't readily available. We just don't want to be rejected over this.

Its just so strange.

Attention anyone reading this:

If you had a joint sponsor for your AOS and filled out more than one I864 please let us know about your processing fees, bills, RFE's for payment etc

( I may make this a new thread)

Hoping for some insight, as seeing that Immigration will send us a bill doesn't completely fill me with a lot of confidence.

Oh - you wouldn't be rejected - they would probably send and RFE, or return the package for the right amount.

I have been using this resource to find these rules - GPO Web access

and it looks like the rule I found above is still in effect, any other rules after that date with the I-864 just increase the price.

Here is the rule in it's entirety: I-864 Rule

So the way it looks like, I-864's need a separate fee, unless they fall under this:

I almost believe they would require a seperate fee for each form (as listed with a fee).

From reading that entire rule, it looks like they discussed not charging fees for situations like the above, but, in the end, said "No".

Now I am really interested if people here were charged extra for co-sponsors using the I-864 only....

Now you know this fee is if the State Department (NVC) is processing the I-864 domestically - right?

For immigrant visas.

(if your doing AOS here in the states, you do not need a visa) (in other words, if it's going to the USCIS - no fee is charged)

So - to the OP -

were you attempting to adjust status of someone here in the states?

Or are you trying to get a visa for someone outside of the states?

(I should of asked this with my initial post - Hope I didn't scare anyone ) :ph34r:

Bobby thanks so much! Awesome detective work! We were freaking out. We have always checked the forums before sending out anything, and to clear up any questions we might have. We honeslty have never seen anything about this posted EVER! So I went into a tail spin. :blush:
