She must not be a citizen (if her father was natural born then why exactly I do not know) because the consulate would never issue a visa to someone who is or has a potential claim to be..... so her claim to citizenship, if she had it, must somehow be gone.

Hi everyone an thanks for the help, I am not going to file any paperwork for sure until we would meet in person, and I am doing the best to keep all paperwork from the beginning as well as chat, and phone records and any money used, in helping her. I will pursue first to try an get her citizenship on the grounds first that her father was An American, and see where this goes, I am sure it can not hurt any. I will talk on the phone and hopefully this summer or fall I will just see about going over there instead of her coming here. I would also like to meet her mom, which she wants me to and also would like me to call and talk with her mom. she is very excited all the time when she talks with me, and I have questioned her and requestioned her on many things to see if any story changes and I have checked when sent money copy of receipts were given to me, I have had photos taken sent to me when asked her computer is old an can not use web cam so I am trying to find an older web cam that works on 98 and also uses parallel port. She has been kind in sending photos of computer of her, her id. She has been more than upfront with me, we have talked religion, to family to make sure no problems anywhere. Where I met her, she removed her profile with me not even asking her too. So all I can do is to trust and hope all works out well.

And if we can not get her citizenship on grounds of her father being American, which she told me her mom receives 3000 peso a month which is not much from his benefits. I will work towards filing a K-1 Which I looked over the form, and it also lets you put down your property and worth an debt, and even though my tax does not show alot I feel will be more than adequate to prove to them of my responsibility and if not I will have my sister be a co sponsor which I am glad to know of this I had never heard of it.

So again thanks for your help and all of your comments and I will continue to read and keep you posted

Let me clear a few things up, I didn't' pay her schooling, her dad put her through school up to the time he died an then her aunt paid, she Graduated from nursing school Last year, What I offered to pay is for her to have her final review and Final coaching an her Nursing Test so she could practice in the Phil, I made this offer she never asked anything about it. Then if she make I told her I would offer to pay for her NCLX Examination because I figured it would be easier for her to take there than here.

She has been more than upfront with me sending me Receipts of the payments to the school for her review , sending me copies of her Valid Photo Identification.

Her dad did not speak of any relation back here in the states and she does not know of any, He Was stationed in the Phil where he met her mom and they were married there, She has only been in the usa 1 time, and that was right after her dad died, she came back here and was here for one week to file paperwork and to fix for her mom to get some pension which is not much, Her mom is 68 and her Dad was 72 when he died.

She has a Valid Visa that is still good from that time and said she would like to come to the usa to see me.

I would never send money for a plane ticket, I would only purchase a non refundable ticket to her to come. if she does, but I am thinking more of going there, 1st to meet her an her mom.

Where I also feel since her dad was an American Citizen that , would be the way to approach getting her here in the USA The whole time her dad was Married he never once came back to the usa and he never talked much about it.

But you can tell by her photos and her Id that she is Half American and Half Filipino.

@@@ Since her dad died and didnt petition her then she will have time getting petition by a dead dad. If the main petitioner file for someone, that petitioner happen to die during the process, the petition itself died. She can try tio get a humanitarian process but even with that will be hard to get it too.

If her Dad is an American Citizen and he signed her Birth certificate as her father, then she's automatically an American Citizen. All she need is to go to an immigration lawyer to help her out on the paperworks. I wonder why the US embassy didn't tell her that when she get her US visa.

I am not sure, but he is listed as her father on her Birth Certificate, and he definitely was an American citizen Only thing is that he died two years ago, and now it may make it more difficult, I guess for my best purposes I will just try for the K-1 and also include that into the process and will hope that will also help with getting her paperwork for coming here.

I don't want to take no chances on her immigration, and if i apply that away, and it doesn't go and then turn around an apply K-1 they may think something fishy or something and may delay the process and the way I look at it, we will both know each other more in a year and be that much more ready to get married, I would rather we both know each other and be no questions. I want it to be Love on her end and not feel also a safety net you might say.

K1 is the best way!!

Visit her once for at least a week or two. meet her family take a lot of pictures , keep your plane tickets, anything that will prove your relationship. And then PRESTO..you can file your K1. As long as your relationship is genuine their is nothing to worry about. The immigration will know..they can spot the not!!! GOOD luck!!

1st If her father was a United States Citizen then she has citizenship so find out how this works first then you can skip all other stuff.

2nd If you NET WORTH is very high all you need to show is 60,000$ worth of something you could sell as an asset and you would meet the guidelines.

3rd They count the LINE 22 income from you 1040. I don't know if you are setup as a C corp or and S corp but the S corp income is carried to you personal taxes and this line is where it is. I am not sure about C corp information sorry.

Thanks for the help, I am checking in on the information both ways on her citizenship by her father being American and also the K-1 I will do more checking on the Citizenship for her and her information when I visit her in the Philippines.

As for my tax records an so on to make sure I am above poverty level I do own way over the 60000. part but I also have loan on part of what I own also, My tax records do not show alot because like I say I farm an is working like a business.

Now let me ask a question, I also have a Trust Fund that was left to me and My sister but it is fixed so we can not sale it which I don't want to with property worth in the area of a 1 million also. Can I list that on the form which I also draw money off of each year.

your trust income is valid as an income source, and would be treated as non-taxable income. provide the documents that order it and a short explanation, as well as some proof that it exists in a trust, and you are good to go, you lucky dog.

Was her dad wealthy? I can never understand why an American would stay in the RP if not wealthy already and if not running from the law.

Also can't understand why he wouldn't at least get his daughter citizenship to the US... has to be a weird situation of some sort.

How many kids does he have?

seems like to me to many here are being judge and jury.. Ok About her comeing here since she has visa and its still good, Why can she not come?? its her choice Plus Yes they can marry why shes he on visit. Then before visa runs out get lawyer to file for papers. Thats what happen to me 6 years ago met a guy from poland visisting on visa. we married he stayed we filed it took one year to get green card end of subject.. Most here have not had this situation so can not speak on it.. Just know most likely will need sponcer or id u and her only ones u need to make like 17,800 or 19,800 taxable income somewhere around there.. This man has a choice to make.. and if its right or wrong he ha sto make the choice.. my feel.. we live and learn.. stop putting here dad down.. My brother is there because he hates usa life.. nothing more, they have respect over there and he is less stressed.. you do not have to be in trouble to be there, are want to live there.. give the man a break
