Poverty Level and Pregnancy

The AOS interview is April 14th and our baby is due April 24th. I meet the 125% poverty level for 2 people but fall short for 3. Will this be a problem since the baby isn't born yet or will they think of it as the 3rd person? Any info is appriciated. Thanks

The consulate needs to be satisfied your fiancee and "family" will not become public charges. Technically, your family size will be two on the day of the interview. The consular officer, not being blind, may well decide to count it as three. They can do that. I would have a co-sponsor prepared. At any rate, 90 days after arrival you have to provide another affadavit of support and will have to show support for a family of three at that time. You may as well be prepared now.

Given that your fiancee will very likely travel to the USA after birth, have you considered the baby's documents? Will you apply for the child to become a US citizen? What is the anticiapted time frame for the child to be acknowledged a citizen and receive a US passport? That is one detail I am not familiar with

Shes already in the US. I'm on the AOS stage not the K1.

I agree with the above poster that you should be armed and ready with a co-sponsor, if they dont ask for it, (which i think the will), you were prepared anyway. I am sure you would rather be prepared than not.

CONGRATS on your soon to be born beautiful baby. Boy or girl??? You ready to be a dad??? (p.s your wife has really cute dimples... maybe the baby will have them )

Hi Eric,. I think I remember you during my Interview at Manila Embassy,. I saw you guys there... Im sorry I have no idea about this topic But I just want to say Goodluck and God bless on your Interview... I had my interview last February, It was very easy and quick.. I got my green card few days after the interview,. and we just came back here in Vegas from the Philippines to visit my family...

Ah, OK. My error. Belay my last. Except I would still be ready with a co-sponsor. You may not need it for AOS though. Best to be prepared

Probably will just have to take the chance. It would probably be too late to get all the required stuff for the joint sponsor anyway, besides the people I asked for joint sponsorship have to think about it. If they say that I will be having a kid and the number is 3, I could always argue that the kid isn't even born yet, and even if she wasn't pregnant, she could have gotten pregnant after the interview and got it up to 3. They should only go by what is current or what was current when I submitted my application not will/might happen in the future.

I don't think it will be a problem personally. But if it is, do you think it will be a flat out denial or an RFE?

I hope you and your wife will be ok on the interview. If the co-sponsor is not possible to have for the interview then just crossed your fingers that the IO is nice. Good luck to both of you and congrats for the coming baby!

She will face removal proceedings if you can't come up with a co sponsor.

They will likely give you a chance to find a co-sponsor...it is an "RFE" for affidavit of support. During our interview, the IO told us that we need to find a co-sponsor or file our 2008 tax return then send the copy to them. The IO gave us an RFE for income requirements with expiration date on it. If you were given an RFE, you must comply within the expiration date. Good luck to you!!!!
