Got RFE notification -- had a priority date of Mar 02

There was some chatter about IMBRA affecting people who had a 129F date of Mar 01 and beyond. My date is Mar 02, and I got the following in the email:

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status:

On June 23, 2006, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 30 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours.

So, don't know if this is a coincidence that my particular case required further evidence, or whether I got caught by the IMBRA. I am curious as to WHAT the evidence will be considering we are married and have already submitted a marriage certificate.

Anyone else get this?

I-129F TRACK

2006-02-27: I-129 Sent

2006-03-02: NOA1

2006-07-24: NOA2

2006-07-31: Case received by NVC

2006-08-01: Case leaves NVC to New Delhi Consulate via DHL

2006-08-04: Case received by New Delhi Consulate

2006-08-08: Packet 3 mailed out by consulate

2006-08-17: DS-230 Part I couriered to consulate

2006-08-23: Got interview date (email and telephone confirmation)

2006-08-28: Picked-up packet 4 from the consulate, counter 16 (between 2 PM and 3 PM)

2006-09-20: Interview Date (VISA Approved!!!)

2006-09-23: Picked up Passport with VISA from Blue Dot courier office (VFS did not hold it)

2006-09-27: Reached Home!!! (POE Chicago)

I-130 TRACK

2006-02-08: I-130 Sent

2006-02-27: NOA1

2006-05-03: NOA2 (Approved)

2006-06-12: Received and entered into NVC system

2006-07-08: Self Generated DS-3032 and sent to NVC

2006-07-08: Received I-864 bill from attorney

2006-07-11: Paid I-864 bill

2006-07-12: Received IV bill

2006-07-17: Receive I-864 package

2006-07-19: Send back I-864 package

2006-07-19: Pay IV bill (was out on vacation)

2006-07-31: Sent in self-generated DS-230 (after NVC was ready)

2006-08-03: Case being reviewed by NVC (per operator)

2006-09-12: Case sent to New Delhi Consulate

2006-10-04: Emailed Consulate and got Original Interview Date (10/20/06) posponed to April 2007

If your receipt/received date on your NOA1 is as you say, dated 2 March, then I will hasten a guess that is nothing to do with IMBRA but more to do with the fact that NBC is up to processing your petition and have sent you an RFE for a document missing or something incomplete. It could be something simple as a question not answered or answered inappropriately. Let us know.

13 Feb. 2006 - sent I-130; 14 Feb. 2006 - I-130 received at Nebraska

28 Feb. 2006 - NOA-1

2 Mar. 2006 - RFE for payment problem; 3 Mar. - corrected & mailed; 6 Mar. - USCIS rec'd payment

12 June 2006 - APPROVED! (NOA-2)

20 June 2006 - case number assigned

3 July 2006 - DS-3032 and AOS Fee bill generated; 6 July - emailed DS-3032 Choice of Agent

13 July 2006 - Received DS-3032 (UK)

14 July 2006 - DS-3032 mailed to NVC

17 July 2006 - DS-3032 and AOS Fee received in mail

19 July 2006 - mailed Fee bill to NVC; recieved at NVC St. Louis facility 20 July

24 July 2006 - Received NVC choice of agent confirmation email

16 Mar. 2006 - NOA1

3 July 2006 - received RFE (IMBRA); 5 July 2006 - mailed RFE response

10 July 2006 - received USCIS email confirming receipt of RFE response

13 July 2006 - received RFE (IMBRA) AGAIN

17 July 2006 - mailed 2nd RFE response; received by USCIS 19 July

27 July 2006 - APPROVED!

7 Aug 2006 - case number assigned at NVC

11 Aug 2006 - Recieved NVC letter confirming case sent to london

23 Aug 2006 - Received Packet 3 / 25 Aug 2006 - Mailed back

04 Sep 2006 - Medical completed.

08 Sep 2006 - Interview date assigned for 2nd October

OK -- I just thought of something -- my attorney had not sent an affidavit of support, saying that my income was sufficient enough that I did not need to send one. Meaning, he never sent one in. Could that be the additional evidence? I am going to be seriously PO-ed if it is because I had asked him TWICE if we needed to send that in.

Another thought -- I am thinking that an attorney is not really required -- does anybody see any real advantage to it?

An affidavit of support (I-134) is not required with the filing of the petition. It will be required at the interview for the K visa.

This is really interesting. IMBRA or No-IMBRA they are still processing K3 applications from March 2.....Wow ....I mean wow ......So looks approval time period is 4 months ! Great !!!!!!!!!1 Things keep getting better and better !
