Greetings to all. Not sure who is still posting here from 2006-2007 era postings, but I thought I would stop by.

The I-175 is next up for my wife, Anh. So we hope everything goes well, as all has before. There really have been no problems with her visa, green card, etc. As you may know, she was approved right away and her interview in Saigon was a breeze.

We are in NYC, so I imagine that means her case will slow to a crawl now. Previously we were in NC.

Evidence is important with the I-175 and so far we will have the following: Sworn affidavits by U.S. citizens; Copies of 2007 and 2008 joint tax returns; Printout showing our joint bank account; printout showing our joint cell-phone bill; copy of our one year apartment lease with both of names on it; Copy of health insurance cards for joint health insurance; Photos of our trips to carious U.S. lcoations over the last three years.

If anyone can advise us what else we might need, that would be great. Anh does not drive, so car related evidence is not possible. We never flew anywhere, other than for free when I worked for U.S. Airways and so we don't have any such evidence.

I do have a question though. The company works for wants to plan a trip to Saigon, since Anh continues to bring in more and more Vietnamese clients. But they want to go in late May. The problem is, Anh's green card clearly has an expiration date of 5/15/2009.

If I understand all of this correctly, when the government receives her I-175 application, she will be sent either a new one year green card or some kind of form signifying all of this, that way she can continue working as well as travel outside of the U.S. and be allowed back into the country.

Am I correct and if so, how long until that happens? Is there another application to receive the ability to travel outside of the country and return? The timing of her company's wishes is really unfortunate, since this would be a FREE way for her to visit her family for the first time since she left them.

That is all. Thanks for reading. :star:

Great to see your post!

We just filed I-751 back in January and my wife received her NOA1 about a week later. It indicates on the NOA receipt that her conditional permanent residence status is extended for a period of one year. During the one year extension you are authorized employment and travel. She still has her original green card.

When my wife went in for her biometrics for the I-751, we requested an I-551 stamp in her passport so that she wouldn't have any trouble traveling to Vietnam in April. You might have Anh schedule an Infopass appointment and request the same thing. I've heard it is hit or miss getting the I-551 stamp, but we were successful. Reason for hit or miss is because technically the NOA1 receipt serves as the one year extension of conditional permanent resident status.

Hope this helped...

Hey gang. My wife's Vietnamese passport expired in 2007, so she really needs to get that taken care of. Tried so many times to get her to do it, but she just ignored me. Now she needs it and will have to rush it. She will likely take the bus to D.C. with a girlfriend and hand it in personally.

I'm not sure I understand what that exemption thing is all about and how it works. There was a great deal of information on that website, but no statement as to what the purpose actually is.

By the way, my wife is still listed in the Book for her family in Saigon. She wants to keep it that way.

A bit of confusion is the Biometrics. Will the government send her an appointment date? Or does she have to make it herself (and if so, how)?

One area that worries me is our address. We just moved to a temp apartment. We know we are moving again in September. That is 100% certain. So should we just go ahead and use the current address and then change it when we move? I'm assuming yes, of course, but just want to get other opinions.

Our evidence is now all that strong, to be honest. I've lost all the envelopes sent to use from friends in the last move. We don't own a home and Anh does not drive, so there is no joint car thing going on here. I'm hoping the other evidence will be strong enough. I'm probably worrying for nothing, as I did in the past.

She will receive another NOA with a biometrics appointment date/time.

Evidence doesn't have to be that strong, really. I found that Green Card stuff to be the easiest part of the whole process. Passport was a problem for Nicole too, but now she has US Passport so problem solved! I don't think Vietnam ever actually relinquishes citizenship to anyone, even if the citizen does.

Good to hear that. We have good evidence, just lacking a few items that I see most submit. When you live in NYC you don't really need a car, so she doesn't have a license and until we have one hell of an income, we can't buy here. Just ain't happening. So we rent.

I know Anh really wants that U.S. Citizenship and passport. No more worries about the limitations of a Vietnamese passport in travelling and it will be easier to get her parents over here to visit once she is a U.S. citizen.

The visa exemption certificate is for people who are spouses or children of a VN citizen (including americans). This is a 5 year visa exemption that goes in your passport, so you won't need to apply for a visa. It costs $20. We did it for our baby that was born in the US so my wife and baby could go visit her family for the first time. Quick and easy.

OK, maybe I am dense, but the I-751 form asks, "Have you resided at any other address since you became a permanent resident? (If yes, attached a list)."

Uh, my wife's 2 year green card expires in May. She is not a permanet resident, as I understand it, so why this question? Am I just confused?

She entered July of 2006 under a K1. We were maried a month later. She received her green card in 2007. Since her arrival here in the USA we have lived in CT, NC and now NYC. So three addresses.

But is she a permanent resident and do I have to now list those addresses?

I do not want to screw this up.

Thanks!

Conditioned GC. That what K-1 folks all had when entered into the US.

Don't worry Matt, it happens after not dealing with USCIS for awhile... You couldn't understand what the heck they are trying to ask you in their forms.

Welcome back Matt and glad you're doing well!
