Hello Everybody,

I'm really glad I found this site. There's not really many people you can ask about this stuff.

I'm currently living in the US and I'm not really legal or illegal. It's sort of a gray area. My family came here about 15 years ago from Pakistan on my father's student visa. His Visa expired about 5 years later and since then they've been struggling to get a Green Card. Thank God everyone in my family is a Permanent Resident... except for me.

When they were applying for it and getting fingerprints and passports and interviews and whatnot, I was still a minor, around 10 years old. For some reason our attorney insisted that I should be excluded from all the proceedings. So my case was never filed, until recently and they say its gonna take a long time to get everything done. 5 or more years.

I didn't really worry about before, but now I'm 18 and I'm starting to feel it. For some reason I have a SSN but no SS Card. My Pakistani passport is expired but I'm working on getting it renewed and my birth certificate is from Pakistan.

I don't drive or work right now, but is it possible for me to? Can I get an ID or a work permit? What are my limitations?

Thats a hard one, these are Fiance-Visa forums.

However, I believe you can Adjust Status based on your presence here already.

On part 2 of the 485, you can click on H - "Other" and dig into your explanation.

The key is to get it filed because once you file the 485, you will receive a Receipt notice which means you have a right to be on this soil--whether or not it takes them 2 years to approve (with RFEs etc)

When you file the 485, don't forget to send in the Employment Authorization Document form (765) too--which allows you to work until you get the green card.

With the EAD, You would be able to walk into any SS office with the EAD and they have to issue you a SS Card

Once you have the SS card, you can walk into any Driver's Registry and obtain a Driver's License.

Your post doesn't make any sense. You say that your father's visa expired and since then they been struggling to get a green card. Yet you go on to say that every one in your family is a permanent resident....so if they are struggling to get a green card, how can they be permanent residents?

You say your case was filed---well, what was it filed under? Depending on that, I suppose we can determine if you can get a work permit....

you are either legal, or illegal. you are either covered by appropriate documentation, or are not. if you were admitted to US under your father's student visa, and his visa expired without conversion to some other form of visa or eventually a green card, he is illegal. if you have no appropriate papers, you are illegal.

It is not a gray area at all. You have no status, hence you have been in the US illegally since your dad's visa expired. You cannot legally work. Consult an immigration attorney.
