guys,

Me and my hubby filed taxes together for 2008 (I worked in the US on visa in 2008).

We are working on I-864 and I have a question regading it:

on 1040 form the amount of income is shown as our toghether - so in I-864 is should just write the petiotioner's income, not the adjusted gross income from 1040 correct?

The I-864 is sponsorhisp from the petitioner, so it should be the petitioners income.

i m on h1 and my wife citizen...we filed our taxes together for 2008...

in i-864, Q24. b. i added my name....

and in 25. i wrote the total income (together) for year 2008 and in parenthesis wrote "Joint Filing"....

my wife's income for the year 2006 and 2007 was above 125% of poverty line for respective years...

for year 2008 it was below 125% of poverty line..but our income together for 2008 is above 125% poverty line....

what do u suggest i should do? is it ok...or should i find another sponsor?

That is entirely not accurate.

You can include the income of the intending immigrant who is your spouse (he or she would be counted on line 21A of the I-864), evidence that his/her income will continue from the current source after obtaining LPR status must be provided. (if you have no accompanying children, you will not need the I-864A).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
