Hi all,

For I-130 application, do I ever need to get the birth certificate for the beneficiary? Also, do I need to travel to my wife's (beneficiary) home country (China) to gather police certificates for all the city she has lived in or is there an easier way?

For filing the I-130 only U.S. citizens birth cert. is required, if you dont have that, copy of your U.S. Passport will work.Biographical page.

For police reports, she need police cert. for every place she lived longer then 6 months, you might want to do a bit of research or maybe someone here and tell you how she can obtain them.

Please note that for the I-130 application, police clearance certificates are not part of the required documentation...

Sorry I should have elaborated, I meant to say for the entire IR-1/CR-1 application (so including I-864, etc.), do I need to get her birth certificate at some point?

Yes. And she will need police certificates, but you dont have to go get them. She can get them and mail them to you.

Police Records link

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

According to a 1957 state council ruling that is still in force, the imposition of a re-education through labor (Lao Dong Jiao Yu) term does not result from a criminal conviction. Administrative organs, rather than courts, impose re-education through labor. It is important to distinguish re-education through labor from labor reform (Lao Dong Gai Zao), which is a sentence meted out for criminal offenses.

yes original certified birth certificate will be needed by the beneficiary at one point in the CR-1 process as well as all pcc that she lived for greater than 6 months (after age 16) at any given time. It is best to get at least 2 copies of these records to save you problems down the road. Good Luck on your VJ.

PS... Please note that there is usually an expiration date on police certificates. Depending on where your at in the visa process, you may want to wait. I don't know your timeline or what stage your at. But you may want to look into how long before they expire before getting them.

Thank you all, you guys are great!

My wife and I are living in Canada now, so it will be hard for her to go back and get the police certificates. Does she have to travel to all the cities she has lived for more than 6 months to get the police certificates? They are quite far apart and she doesn't have any family members in those cities.
