Hi

I have a question about the EAD.

I entered the US on January 7, 2009 on K1 visa.

Then I made a mistake and applied for an EAD 2 weeks after entering the US (based on my I-94 status).

I got married after a month of entering the US, and then I applied for the AOS (and also for a new EAD).

Just a few days ago, my first EAD arrieved in the mail and it is only good until my I-94 expires which is April 7, 2009, which sucks.. not even enough time to find a job.

So now I am just wondering CAN I renew it based on my AOS status that is pending right now (I got my NOA and got my Biometrics done a week ago), and if I can, can I do it through INFOPASS and would it be free?

And what about the EAD (the one that I applied for when I applied for AOS) which is still pending?

did you pay for that first ead?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The EAD you got was based on your I-94 status at the time - it's not renewable (unfortunately). We (here on VJ) discourage folks from doing this for the very reason you described.

The one you applied for now/recently is based on your pending AOS which will be renewable (should you actually need to renew it, meaning if you don't get your PR/Green Card in time).

When you submit your second EAD, it should not be in the same eligibility category as the first one. I believe that, the first one is under (a) (9). and the second one is under ( c) (9). Thus, it is not considered as renewal.

You are right. It is a wasted 340.00dollars.
