Hi. I am married to US citizen, and applied for green card through marriage. Before that I had F-1 status, lost it, and was out of status for 1 year.

In a couple months we will have our initial interview. I was wondering if I can go back to my country for a couple weeks because one of my relatives iz very sick.

And also what is the reason to postpone an interview? If I am ill for that day, can I just call day before and reschedule it?

1) DO NOT LEAVE THE COUNTRY WITH AP. OTHERWISE WE WON'T BE ABLE TO SEE

YOU HERE, IN US FOR 10 YEARS.

2) DO NOT RESCHEDULE YOUR INTERVIEW, IT IS REALLY VERY BAD IDEA.

GOOD LUCK !....

HERE IS MY TIMELINE :

I-130 mailed 01/13/09

I-130 received by USCIS 01/16/09

NOA1 Mail for I-130 received 01/22/09

I-485 Package received by USCIS 02/20/09

NOA2 e-mail for I-130 Approval 03/03/09 (47 Days)

NOA2 Hard Copy of I-130 Approval received 03/07/09

Biometrics App. Mail Notice received 03/09/09 (App. Date 03/24/09)

yeah u couldn't be more right..i wouldn't even have thought of AP if i were u. i was in your exact shoes...f-1, lost it, out of status..AP was the furthest thing from my mind! do not leave the country and do not reschedule the interview...you might have to weight it for yourself but is it more improtant to see the sick relative and jeopardize your re-entry?

Because you overstayed (out of status), you would most likely be refused re-entry and incur a 10-yr ban for the overstay, even with AP.

If you stay in the US until the AOS is apprived, the overstay will be "forgiven" and you will be allowed to travel.

Rescheduling an interview is not recommended. People who have rescheduled have been denied because they didn't show up for their original interview, even though they received a new interview notice. Unless you are deathly ill, you should go to your scheduled interview.
