My brothers is happily married with his wife. She came from Cuba 2 years ago and she is a legal resident of the United States, I heard that through the Cuban Refugee Adjustment Act she can claim my brother and adjust status. What is the process? the same as Citizen petition for spouse? there is any other form that they need to fill out?

01/??/05 Workers permit received.

Got Social Security Card!!!

08/29/2005 Interview went awesome!

09/??/2005 Green Card arrived!!!!!!!! YUPY!!!!!!!!!!!!!!!!!

Removal of Conditions:

06/01/2007 Send package to TEXAS Service Center

06/07/2007 Received NOA

09/20/2007 Went to get an stamp, denied stamp at the Miami USCIS Office =(

01/31/2008 Transfer to Vermont Service Center (after almost 8 months!)

02/22/2008 This case is now pending at the office to which it was transferred.

02/26/2008 This case is now pending at the office to which it was transferred. (Last Touched)

07/01/2008 : still waiting for a miracle after 390 days of suffering....

07/02/2008: Infopass Appointment. passport Stamp....

07/03/2008: Incredible!!!! Card Production Ordered!!!!!!

07/04/2008: Touched. Duplicate email Card Production Order

07/07/2008: Touched

07/08/2008: Touched. Email with notice of approval

07/09/2008: Touched again!

Unless she is a USC citizen, your brother CAN'T adjust status. If she is a LPR, that's an approximate 5 yr wait for the visa number to become available. No, your brother can't wait out the visa number to become available in the US, he has to go back to his home country.

I'm not sure what the specifics are of the Cuban Refugee Act are, but if she is a permanent resident of the US, she can file an I-130 spousal petition to bring her spouse to the US. I'm not sure if those petitions filed by residents are processed any differently than those filed by citizens.....you may try posting your question in the Bringing Family Members of Permanent Residents to America thread, you may get more appropriate answers.

Yes, it's the same way like he's married to USC.

My friend did this 7 months ago with his Cuban wife who is a LPR,

and not a USC.

Two weeks ago he got his green card for 10 years!!!

I could not believe it!!!

His GC expires on 2019, and under category is CU7, which I have no idea what that is,

but sure not a conditional card.
