It appears that Gabriella will get permission to take her son with her when she leaves Brazil, just not in the time frame we thought it would be possible. We are looking at 3 - 12 months more before we get the authorization from the Judge. Her interview at the US Consulate is 3/24.

Should she go to the interview anyway (without her son), and hope that she will receive the authorization for her son sooner than later, then apply for her son?

Should she ask for a delay in interview?

The best move would be to contact your embassy and ask about the options. Quite often there is a chance of delaying one's interview, but to be safe, do not try to do anything without the Embassy's blessing.

Probably best to delay. The problem comes that her son must follow within 12 months of her K-1 issue date. Since you have no control on when the courts will act, or what they will decide you could find yourself in a very bad situation

The advise to contact the consulate is good.

For those of you following the thread, Gabriella called the US Consulate on Friday the 13th. They told her to send them an email with the circumstances, and the reason she would like to suspend the processing of her visa. They said that they would respond within a week's time. The person on the phone gave a lot of good information and said that she might be able to delay the visa up to 2 years. I hope we don't need that much time! It does seem like her court case will take a lot more time, so I guess you guys are stuck with me for a while.

I will post the "facts" from the US Consulate when we get the email.
