Filling for AOS, any idea?

Timeline

I and my son got here through k1 and k2. There was some delays on our filling due to financial problems. Now we are ready to send our paper work. Does my son needs to fill up on I-485? or that is including on my I-485 already? This drives me nuts..

Please help!!...

each intended permanent resident requires there own set of application forms and there own separate fee... no riding the coat tail here on this one

Separate I-485 needs to be filed for your son.

I-485

Filing Fee :

$930 plus a biometrics fee of $80; the fee total is $1,010. Exceptions listed below. There is no fee for applicants who are filing Form I-485 based on having been admitted to the United States as a refugee. Applicants 80 years of age or older are not charged a biometric fee; the fee total is $930. Applicants under 14 years of age: - Filing with the I-485 application of at least one parent have a fee total of $600 - Not filing with the I-485 application of at least one parent have a fee total of $930

The fee varies:

$1010 if K-2 is 15 or older,

$930 if 14 or younger and not filed with the K-1's I-485.

$600 if 14 or younger and IS filed with the K-1's I-485.

Both I-485's should be filed together in same envelope.

So he does need his own AOS even it says on the I-485 applying with you? He is only 4 yr. old. Does it mean that we both have paper work on our own? Coz when my husband petition us, he only fill up one form for us except for G325. I thought it would be the same.. thanks for the comments

each person need there own... does not matter if 4 or 14.... very much not the same...

Yes each person needs an I-485 to adjust status, you only get a price break $600 rather then $1010 for K-2 adjustment of status.

One option AFTER son get's green-card is for your spouse to adopt your son, this is a shortcut to citizenship, and bypasses removal of conditions for your son.

NOTE son needs to be an IMMIGRANT, (Green-Card Holder) to do this.
